J�tYosy,, , ' <br /> COUNTY OF HAWAII • <br /> • STATE OF HAWAII <br /> ,• rtEOFN'�' ' <br /> RESOLUTION NO. 215 19 <br /> RESOLUTION AUTHORIZING THE OFFICE OF THE MAYOR TO ENTER <br /> INTO AN AGREEMENT WITH THE STATE OF HAWAII SURPLUS <br /> PROPERTY OFFICE FOR THE ACCEPTANCE OF A DONATION OF A <br /> HYDROGEN BUS <br /> WHEREAS, the State of Hawaii, Surplus Property Office is donating a 2012 <br /> F550 ENC Aero Elite Bus (Hydrogen Bus) to the County of Hawai`i's Mass Transit <br /> Agency; and <br /> WHEREAS, the bus will be used as part of the Mass Transit Agency's <br /> transportation fleet; and <br /> WHEREAS, the County of Hawaii will be obligated to pay a service and handling <br /> fee of approximately $500 to the State of Hawaii, Surplus Property Office; and <br /> WHEREAS, pursuant to Hawaii Revised Statutes, Section 46-7, this Council's <br /> consent is required to enter into this agreement; and <br /> WHEREAS, Article XIII, Section 13-12, of the Hawaii County Charter provides <br /> that the Council, on behalf of the County, may accept gifts of donations of money, <br /> securities or other personal property or of real estate or any interest in real estate, and <br /> Chapter 2, Article 30, Section 2-162 (a) of the Hawaii County Code states that any gifts <br /> or donations of money, securities, or personal property which fall within the <br /> capitalization procedures of the Department of Finance, may be accepted by resolution <br /> approved by the Council; and <br /> WHEREAS, the County of Hawai'i's Mass Transit Agency recommends the <br /> acceptance of this donation; now, therefore, <br />
