No. 532/Bill No. 109 <br /> PLACE: Council Chambers <br /> Hilo, Hawaii <br /> TIME: 2:30 p.m. <br /> Council Chair and Members <br /> Hawaii County Council <br /> Hilo, Hawaii 96720 <br /> Your Committee on Agriculture, Water, Energy, and Environmental Management,to which was <br /> referred Bill 109, reports as follows: <br /> Bill 109,transmitted by Council Member Herbert M. "Tim" Richards, III, via Communication No. 532 <br /> dated September 11, 2019, revises provisions relating to the 45-day period for review of amendments to <br /> Chapters 20 (Refuse) and 21 (Sewers). <br /> The intent of Bill 109 is to clarify the ambiguity stated in the County Code; allowing the Environmental <br /> Management Commission(EMC)the leverage of their vote to a"neutral recommendation" if the <br /> Council does not receive a reply from the commission, on matters relative to Chapter 20 or 21 of the <br /> County Code within the mandated 45-day window. This will allow the Council to continue the <br /> conversation of the legislation or communication as it awaits word from EMC. Department of <br /> Environmental Management Director Bill Kucharski added that this will streamline the process by <br /> amending any non reply from EMC from a negative to a neutral recommendation.
