....-„:;"1-7-9 ......... , <br /> COUNTY OF HAWAII •( �''~=\�' / * STATE OF HAWAII <br /> .r7 •711* <br /> . <br /> RESOLUTION NO. 423 '19 <br /> A RESOLUTION AUTHORIZING THE PAYMENT OF FUNDS OF A LATER FISCAL <br /> YEAR AND OF MORE THAN ONE FISCAL YEAR FOR MULTI-YEAR LEASES OF REAL <br /> PROPERTY FOR THE COUNTY OF HAWAII DEPARTMENT OF ENVIRONMENTAL <br /> MANAGEMENT <br /> WHEREAS, Section 10-11 of the County Charter requires that any contract, lease or other <br /> obligation requiring payment of funds from the appropriations of a later fiscal year of more than one <br /> fiscal year be approved by resolution; and <br /> WHEREAS, the County of Hawaii Department of Environmental Management desires to <br /> construct a new Compost Facility which will allow for the significant diversion of organic materials <br /> away from the waste stream in accordance with a signed contract between the County of Hawaii and <br /> Hawaiian Earth Recycling, LLC in the W. H. Shipman Industrial Park in the Puna District, <br /> WHEREAS, the County of Hawaii Department of Environmental Management desires to <br /> enter into a multi-year lease agreement for a 19.5 acre portion of TMK (3) 1-6-003:090 within the W. <br /> H. Shipman Industrial Park, Puna, Hawaii, and owned by W. H. Shipman, Limited ("Landlord") <br /> commencing on or before January 1, 2020, for a seven year term ending January 1, 2027, with two <br /> additional five year options with the Landlord; and <br /> WHEREAS, the County of Hawaii Department of Environmental Management is requesting <br /> authorization for the Mayor to enter into multi-year lease agreements with Landlord for the <br /> aforementioned property; now, therefore, <br /> BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that the <br /> Honorable Harry Kim, Mayor of the County of Hawaii, is hereby authorized to enter into a multi-year <br />
