COUNTY OF HAWAIJ STATE OF HAWAIJ <br />BILL NO. 123 <br />SECTION 1® Purpose. Many Hawaii County subdivisions are situated within areas that <br />are zoned agricultural. The purpose of this ordinance is to promote economic recovery, in areas <br />adversely affected by the recent volcanic eruption, by stimulating small business growth within <br />large agricultural subdivisions. This will be accomplished by reducing the filing fee from $500 <br />to $100 to apply for a use permit, to conduct home occupations in an agriculture zone, pursuant <br />to section 25-4-13. <br />SECTION 2. Chapter 25, article 2, division 6, section 25-2-62 is amended to read as <br />follows: <br />"Section 25-2-62. Application for use permit; requirements. <br />(a) An application for a use permit shall be made to the commission, in accordance <br />with its rules, on a form prescribed by the commission. <br />(b) The application shall be accompanied by: <br />(1) A filing fee of $500; except that the filing fee shall be $100 for applications <br />for a home occupation in the A district, pursuant to section 25-4-13. <br />(2) A description of the property in sufficient detail to determine the precise <br />location of the property involved; <br />(3) A plot plan of the property, drawn to scale, with all existing and proposed <br />structures shown thereon; <br />(4) A list of names, addresses and tax map key numbers for those owners and <br />lessees of record of surrounding properties who are required to receive notice <br />under section 25-2-4; and <br />(5) A written description of the proposed use and a statement of objectives and <br />reasons for the request, including an analysis of how the request satisfies each <br />of the standards contained in section 25-2-65." <br />
