STATE OF HAWAII <br /> • <br /> •ATE OF i4. <br /> RESOLUTION NO. 448 20 <br /> A RESOLUTION AUTHORIZING THE OFFICE OF THE MAYOR TO ENTER INTO <br /> AGREEMENTS WITH: 1) THE STATE OF HAWAII DEPARTMENT OF <br /> TRANSPORTATION HARBOR DIVISION AND 2) THE UNITED STATES ARMY <br /> CORPS OF ENGINEERS TO ASSIST WITH A HILO BAY WATERSHED STUDY IN <br /> SOUTH HILO, HAWAII PURSUANT TO HRS § 46-7 <br /> WHEREAS, Hilo Bay is a navigable waterway in South Hilo, County of Hawaii <br /> ("County") within the jurisdiction of the United States Army Corps of Engineers ("ACOE") and <br /> the State of Hawaii Department of Transportation Harbors Division ("Harbors Division"); and <br /> WHEREAS,the waters of Hilo Bay are considered quality impaired under state and <br /> federal water quality standards; and <br /> WHEREAS, improving the quality of the waters of Hilo Bay will provide economic, <br /> ecological, and recreational benefits to the County and its residents; and <br /> WHEREAS, the Water Resources Development Act of 1974 (Public Law 93-251), as <br /> amended, provides authority for the ACOE to assist in the preparation of comprehensive plans <br /> with local jurisdictions for the development, utilization, and conservation of water and related <br /> land resources; and <br /> WHEREAS, pursuant to its authority under the Water Resources Development Act of <br /> 1974, the ACOE has developed and implemented the Planning Assistance to States (PAS) <br /> Program, which would allow for the ACOE to conduct a study of the Hilo Bay watershed to <br /> improve water quality ("Hilo Bay Watershed Study") with local governmental authorities <br /> contributing to the costs of this study; and <br /> WHEREAS, the Harbors Division has stated that the State is able to help contribute to <br /> the costs of the Hilo Bay Watershed Study; and <br /> WHEREAS, a Hilo Bay Watershed Study is consistent with the State's Ocean Resources <br /> Management Plan under the Coastal Zone Management Program and the Hawaii County <br /> General Plan; and <br /> WHEREAS, pursuant to Hawaii Revised Statutes, Section 46-7, this Council's <br /> authorization is required for the County to enter into intergovernmental agreements; now, <br /> therefore, <br />
