011 OS M .. <br /> COUNTY OF HAWAII STATE OF HAWAII <br /> RESOLUTION NO. 468 20 <br /> A RESOLUTION AUTHORIZING THE ACCEPTANCE OF ALL FUTURE <br /> DONATIONS FROM THE DANIEL R. SAYRE MEMORIAL FOUNDATION TO THE <br /> COUNTY OF HAWAII. <br /> WHEREAS, the Daniel R. Sayre Memorial Foundation ("Sayre Foundation") was <br /> established in 1997 by Dr. Frank Sayre and Laura Mallery-Sayre in memory of their son who <br /> died in a tragic hiking accident at Pololu Valley that year and in honor of the Hawai`i County <br /> Fire Department rescue team who worked tirelessly to recover him; and <br /> WHEREAS, the Sayre Foundation was designed for the sole and specific purpose of <br /> providing much needed equipment and training to the Hawai`i County Fire Department, and <br /> since its establishment, has raised almost $5,000,000 in furtherance of that mission; and <br /> WHEREAS, donations by the Sayre Foundation to the County of Hawai`i are made at <br /> various times of the year and are accepted by the Hawaii County Council via resolutions, <br /> pursuant to Article XIII, Section 13-12 of the Hawai`i County Charter(Acceptance of Gifts or <br /> Donations), which provides that "[t]he council, on behalf of the county, may accept gifts of <br /> donations of money, securities or other personal property or of real estate or any interest in real <br /> estate"; and <br /> WHEREAS, although both the administrative and legislative branches of county <br /> government have placed a high priority on expediting the acceptance of these donations, the <br /> process sometimes takes months to complete; and <br /> WHEREAS, it is in the best interest of the public that a more expeditious manner of <br /> accepting possible life-saving equipment and training from the Daniel R. Sayre Memorial <br /> Foundation be developed; now, therefore, <br /> BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that <br /> henceforth, all donations by the Daniel R. Sayre Memorial Foundation of equipment and/or <br /> training support shall be deemed accepted by the Hawai`i County Council, on behalf of the <br /> County of Hawai`i, upon receipt by the County, provided that a report of the donation is <br /> submitted to the Council by the Finance Director within 30 days of County's receipt thereof. <br /> BE IT FURTHER RESOLVED that this method of accepting donations from the <br /> Daniel R. Sayre Memorial Foundation shall remain in effect until it is rescinded or otherwise <br /> modified by the Hawai`i County Council. <br />
