SECTION 8. Chapter 12, article 4, section 12-53 of the Hawai`i County Code 1983 (2016 <br /> Edition, as amended) is amended by amending subsection (f) to read: <br /> "(f) The council may provide for payment to the contractor, or to the owner or the <br /> owners' representative designated pursuant to section 12-24(d), of the contract price <br /> of the improvement by means of progress payments during the period of the work, <br /> such payments in bonds at par or in cash or both." <br /> SECTION 9. Material to be repealed is bracketed and stricken. New material is <br /> underscored. In printing this ordinance, the brackets, bracketed and stricken material, and <br /> underscoring need not be included. <br /> SECTION 10. Severability. If any provision of this ordinance, or the application thereof to <br /> any person or circumstance, is held invalid, such invalidity shall not affect other provisions or <br /> applications of the ordinance which can be given effect without the invalid provision or application, <br /> and to this end, the provisions of this ordinance are declared to be severable. <br /> SECTION 11.
