JMtY os Ir ;,,, <br /> 11 <br /> • i <br /> COUNTY OF HAWAII 14j2 !'• <br /> ! : STATE OF HAWAI I <br /> TE OF MAS_. <br /> RESOLUTION NO. 488 20 <br /> A RESOLUTION AUTHORIZING THE OFFICE OF THE MAYOR TO ENTER INTO <br /> AN INTERGOVERNMENTAL RIGHT-OF-ENTRY AGREEMENT WITH THE STATE <br /> OF HAWAII DEPARTMENT OF LAND AND NATURAL RESOURCES,PURSUANT <br /> TO HRS § 46-7, TO OBTAIN ACCESS TO CERTAIN STATE LANDS MAKAI OF <br /> BAYFRONT HIGHWAY LOCATED AT WAIAKEA, SOUTH HILO, HAWAII, FOR <br /> THE PURPOSES OF CLEARING EXISTING DRAINAGE CONDUITS, DEBRIS <br /> REMOVAL AND MAINTENANCE OF THE SAME <br /> WHEREAS, there are certain State lands located makai of Bayfront Highway, Waiakea, <br /> South Hilo, Hawaii, which are under the jurisdiction of the State of Hawaii Department of <br /> Land and Natural Resources ("DLNR"); and <br /> WHEREAS, said State lands are identified as TMK Nos.: (3) 2-3-004:014; (3) 2-3- <br /> 003:001, 004, 027, and 028; (3) 2-3-002:016; (3) 2-3-001:003; and (3) 2-2-005:004, and 006, as <br /> depicted on the map attached hereto as Exhibit"A" (collectively "State Lands"); and <br /> WHEREAS, the existing drainage outlets exiting to the Hilo Bayfront from <br /> Kamehameha Avenue / HWY-19 are regularly plugged by tidal action with sand, rocks and other <br /> debris; and <br /> WHEREAS, clearing the drainage conduits and removing the debris is necessary to <br /> better facilitate conveyance of drainage runoff to the ocean, and help to and alleviate roadway <br /> closure of Kamehameha Avenue; and <br /> WHEREAS, the County is able to provide the necessary manpower and resources to <br /> perform the required regular maintenance; and <br /> WHEREAS, it is in the County's best interest to minimize roadway closures on <br /> Kamehameha Avenue; help provide a safe and healthy environment for its residents and visitors; <br /> and <br /> WHEREAS, the County's Department of Public Works has requested that the County be <br /> granted a right-of-entry to enter upon the State Lands for the purposes of clearing existing <br /> drainage conduits, debris removal and maintenance of the same; and <br /> WHEREAS, pursuant to Hawaii Revised Statutes, Section 46-7, this Council's <br /> authorization is required for the County to enter into such an intergovernmental right-of-entry <br /> agreement; now,therefore, <br /> BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that in <br /> accordance with Hawaii Revised Statutes Section 46-7, the Mayor of the County of Hawaii is <br />
