Pursuant to Hawai'i County Code (HCC) Sec. 3-22(a), I am forwarding Taylor Family
LTD Partnership/ 74-5035 Queen K 76's drawings and application for a sign permit. The
owner of the property is Taylor Family LTD Partnership/ 74-5035 Queen K 76 and the
sign will advertise the 76 gas station fuel prices. The applicant's representative is
Zendo Kern, of Zendo Kern Planning Consultant, whose phone number is (808) 333-
3393. The applicant is requesting a sign variance for one ground sign.
The proposed is a second ground sign; an update to an existing unpermitted ground
sign, as depicted in the attached drawings, is located at 74-5035 Queen Kaahumanu
Highway, Kailua-Kona, HI, 96740, is 23.96 square feet in area, and a maximum
elevation of 17' above grade.
Section 3-6(b)(3) & Section 3-11(a)(2)(A)(ii), Chapter 3, Hawai'i County Code, allows for
one ground sign per lot, not to exceed twenty-four square feet and not to exceed
twelve feet in elevation from the ground, in Limited Industrial Districts with lot
frontage in excess of one-hundred lineal feet.

This letter is to formally request a variance from Hawaii County Code to allow for two (2)
ground signs to be permitted on the subject lot located at 74-5035 Queen Kaahumanu
Highway, on the corner of Queen Kaahumanu Highway and Honokohau Street (Figure
1). The subject property, identified by TMK number (3) 7-4-008: 055, is zoned Limited
Industrial 3-acres (ML-3a), and is 3.45 acres in size.
The proposed second ground sign will be located along the Queen Kaahumanu
Highway side of the property proximate to the northwest entrance to the parking lot
(Figure ).
The proposed sign is intended to let customers know of gas availability and prices. The
sign shall be no more than 69" tall, and the "76" monogram logo shall be no larger than
31" tall with a total sign area no greater than 24 square feet for each sign (Figure ).
The sign will be mounted on an existing pole so that it stands no higher than 17 feet
from the ground.
Specifically, the requested variance is from Hawaii County Code, Chapter 3, Signs,
Division 4, Sign Regulations, Section 3-6, Type, number, and size of signs permissible,
(b)(3), which states:
(b) Sign type, number, and size restrictions shall be applied per lot or, if the lot is
occupied by multiple businesses, per business establishment, or if a business occupies
multiple adjacent lots, per business establishment. These restrictions shall be subject to
the following provisions:
(3) Only one ground sign shall be permitted per lot, even if the lot is occupied by
multiple businesses.

As well as from the height limitations imposed in Section 3-11, Signs permitted in
commercial/industrial districts (RCX, V, CN, CG, CV, MCX, ML, MG), (a)(2)(A)(ii), which
states:
(a) The following types of signs are allowed, with permits, in all districts:
(2) Ground sign,
(A) One ground sign, relating to business(es) conducted on the premises,
as follows:
(ii) If lot frontage is greater than one hundred lineal feet ground
sign may not exceed twenty-four square feet and not exceed twelve
feet in elevation from the_qround.
On August 8, 2018, the applicant received a Plan Review Comment Letter from the
County indicating that only one ground sign is allowed on the subject property and that
the applicant's "Tesoro" ground sign was un-permitted as a second sign in addition to
the existing ground sign (52004-0011 K) for the Honokohau Commercial Plaza (Exhibit
A). The applicant wishes to remove and replace the existing (2) cabinet signs on the
existing pole with the new "76" cabinet sign with a maximum proposed height of
seventeen feet above grade. The purpose of the proposed sign is to identify the location
of the applicant's business premises for the public and inform of gas prices. The sign
will be of an appropriate scale and setback.
Gas stations are a special kind of business with unusual advertising needs. As the price
of fuel changes frequently, signage indicating the current price of gasoline and diesel is
critical information for customers deciding which fueling station to stop at. Therefore,
having a sign readily visible and readable from the roadway is not only essential to the
business but also helpful to the public.
Granting the requested variance will not adversely affect the rights of adjacent property
owners or tenants as the old sign has been in place for many years with no ill effects or
complaints. The sign is unobtrusive, set back 75 feet from the property line, partly
screened by palms and is only readily seen if one is looking for it. The sign does not
obstruct views of the coast or the mountain from Queen Kaahumanu Highway.
Granting the requested variance will not unreasonably violate the interest, safety,
convenience, or general welfare of the public. The sign has been in place for many
years without noted ill effects. The sign does not block any notable views, is of sound
construction and sited at an appropriate location on the property. Further, as noted
earlier displaying fuel prices to passing motorists is helpful to the public.
A strict application of the terms of this chapter would work unnecessary hardship and
practical difficulty upon the applicant because site conditions including setback,
topography, and long-established landscaping, make visibility of the business building

signage and current fuel prices difficult. Further, removal of the sign would be a
disservice to the public as the price of fuel would not be obvious from the highway.
A draft resolution, that satisfies the requirements of sections 3-22 and 3-23, is enclosed
(Exhibit B).
