t _ <br /> Michael Yee <br /> September 9, 2019 <br /> Page Three <br /> Kohala Shoreline, LLC, understands that the Hawaii County Planning Department, based on its review <br /> of the Draft Environmental Assessment previously submitted, comments on the Draft EA and responses <br /> to them, has determined that the proposed action,will not significantly alter the environment, as impacts <br /> will be minimal and has accordingly issued a Finding of No Significant Impact (FONSI). Please refer to <br /> your letter dated July 24, 2019 to Scott Glenn. <br /> In consultation with your staff, they have requested the Change of Zone Application and Application for <br /> the Special Management Area Use Permit be consolidated into one application booklet, with the <br /> understanding that each application will be considered separately through their individual regulatory <br /> processes. The Hawaii County Leeward Planning Commission will consider and make a determination <br /> on the SMA application and will make a recommendation on the Change of Zone application which will <br /> be forwarded to the Hawaii County Council for a determination. <br /> 7 <br /> Please find enclosed the original and twenty (20) copies of the application booklet which includes in part <br /> -- the executed Special Management Area Use Permit Application signature page, the executed Change of <br /> Zone Application and the executed Residential Rezoning Attachment. I have enclosed a check made <br /> payable to the County Director of Finance in the amount of $500 for the filing fee for the SMA <br /> application and another check in the amount of $650 for the Change of Zone Application. A list of <br /> neighbors within 300-feet of the perimeter of the property is included as required for notifications in <br /> accordance with Hawaii County Zoning Code Section 25-2-4. 1 have also enclosed a full-size (2' x 3') <br /> site plan for presentation purposes. <br /> We understand under Planning Department Rules an approved Chapter 343 Final Environmental <br /> Assessment is acceptable for the SMA application and the County Environmental Report section of the <br /> Change of Zone Application. There is a copy of the FEA along with all exhibits included in each ' <br /> application booklet. I note the Planning Director, due to the significant setback from the shoreline, has <br /> Py reviousl waived the requirement for a Shoreline Certification for this proposed project and request a <br /> confirmation that a Shoreline Certification is not required. <br /> a review of these <br /> We request that your department execute applications and make a favorable <br /> recommendation to the Planning Commission.
