.J�tYOsp,• <br /> COUNTY OF HAWAII e• STATE OF HAWAII <br /> RESOLUTION NO. 561 20 <br /> • <br /> RESOLUTION AUTHORIZING THE OFFICE OF THE MAYOR TO <br /> ENTER INTO A MULTI-YEAR MEMORANDUM OF AGREEMENT <br /> WITH THE UNIVERSITY OF HAWAII, WATER RESOURCES <br /> • RESEARCH CENTER, PURSUANT TO HRS SECTION 46-7, AND <br /> HAWAII COUNTY CHARTER SECTIONS 10-11 AND 13-13, TO <br /> PROVIDE TRAINING TO WASTEWATER TREATMENT WORKS <br /> OPERATORS. <br /> WHEREAS,the University of Hawai`i, by its Water Resources Research Center(UH- <br /> WRRC), sponsors and administers the Statewide Wastewater Operator Training Center <br /> (SWOTC); and <br /> WHEREAS,the SWOTC serves the four (4) counties of the State of Hawai`i; and <br /> WHEREAS,the SWOTC provides wastewater training classes, and upon completion <br /> of such classes, operating personnel are awarded Continuing Education Units, qualifying them <br /> to sit for exams for obtaining and/or renewing an operator certification; and <br /> WHEREAS, this is a multi-year agreement under which the SWOTC will provide <br /> twelve (12)training courses per year for a five (5) year training program; and <br /> WHEREAS, Hawaii Revised Statutes, Section 46-7 requires the County to obtain the <br /> consent of the Council;to enter into agreements with the Federal or State governments <br /> respecting action to be taken pursuant to any of the powers granted by law to furnish, expend, <br /> and receive any funds or other assistance in connection with projects being or to be <br /> undertaken pursuant to those powers; and <br /> WHEREAS the Hawaii County Charter, Section 10-11 requires that any contract, <br /> lease or other obligation requiring payment of funds from the appropriations of a later fiscal <br /> year or of more than one fiscal year shall be made or approved by resolution; and <br /> WHEREAS the Hawai'i County Charter Section 13-13 allows the county to enter into <br /> contracts with private parties, other counties, the State or the United States for the <br /> performance of any function or activity which the county is authorized to perform; and <br /> WHEREAS the Hawai'i County Charter §13-13(b) requires that such contracts: Be <br /> authorized by the council by resolution if legislative action is necessary to implement the <br /> contract; now, therefore, <br />
