• <br /> M . <br /> ,9!..... <br /> COUNTY OF HAWAI <br /> STATE OF HAWAI I <br /> •, + w:��� <br /> RESOLUTION NO. 682 20 <br /> A RESOLUTION AUTHORIZING THE OFFICE OF THE MAYOR TO ENTER INTO <br /> AN INTERGOVERNMENTAL LIMITED RIGHT-OF-ENTRY AGREEMENT WITH <br /> THE HAWAII PUBLIC HOUSING AUTHORITY, STATE OF HAWAII, PURSUANT <br /> TO HRS § 46-7, TO OBTAIN ACCESS TO LANAKILA HOMES, TMK: (3)2-4-028:007 <br /> FOR THE PURPOSE OF ROAD RESURFACING <br /> WHEREAS, the Hawai`i Public Housing Authority, State of Hawaii ("HPHA"), and the <br /> County of Hawaii ("County") are each responsible for maintaining certain streets ("Streets") <br /> within the limits of the Lanakila Homes housing project, TMK: (3) 2-4-028-007 ("Property"); <br /> and <br /> WHEREAS, County is able to complete the necessary road resurfacing work to maintain <br /> those Streets in good repair and HPHA will improve certain portions thereof; and <br /> WHEREAS, County's Department of Public Works wishes to enter into a limited right- <br /> of-entry agreement with HPHA to enter upon the Property for the purpose of completing said <br /> road resurfacing work; and <br /> WHEREAS, Hawaii Revised Statutes, Section 46-7, requires County departments <br /> obtain the consent of Council to enter into agreements with the State of Hawaii respecting <br /> action to be taken pursuant to any of the powers granted by law to furnish, expend, and receive <br /> any funds or other assistance in connection with projects being or to be undertaken pursuant <br /> those powers; now, therefore, <br /> BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that in <br /> accordance with Hawaii Revised Statutes Section 46-7, the Office of the Mayor of the County <br /> of Hawaii is authorized to execute, on behalf of County, said intergovernmental limited right-of- <br /> entry agreement and any related documents with HPHA to enter upon the Property for the <br />
