Smith: corporation Counsel Schoen, could you read the Complaint? <br />Schoen: Thank you, Mr. Chair. Actually, based upon the Licensee's choosing Alternative I, we <br />are going to dispense with reading the Complaint because you just read it and the Licensee is <br />admitting to the violations. <br />Smith: The Licensee, Oriental Garden, LLC, dba Club Rose, has selected Alternative I, admitting <br />to the allegations and stipulates that disciplinary action may be taken without the presence of the <br />licensee and that the licensee has waived their right to a hearing and appeal. <br />Smith: Do I have a motion to find the Licensee in violation of the charges in Counts 1 and 2 and <br />pursuant to the Department's Motion, dismiss Count 3? <br />Mukai: So move. <br />Schoen: Mr. Chairman, if I may, the Department is going to request a motion to dismiss Count 3. <br />The reason is that the Department has worked with the Licensee and we believe that the last count <br />should be dismissed. <br />Masuda: The motion as it stands will be motion to find them in violation of Counts 1 and 2, and to <br />dismiss Count 3. <br />Taniguchi: Second. <br />Mr. Mukai moved that the Licensee in Case No. 2018-009, be found in <br />violation of Rule 3-1(F)(3) of the Rules and Regulations of the Liquor <br />Commission of the Department of Liquor control of the county of Hawaii, <br />State of Hawaii, for failure of employee (Mi Yong Arce) in Count 1, and <br />employee (In Won "Michele" Jun) in count 2, to register as a hostess with <br />the Department of Liquor Control prior to such employment as a hostess <br />at Club Rose; seconded by Mr. Taniguchi. <br />Smith: Moved and seconded.
