The meeting was called to order by Chair Shelby Nahale-a at 10:00 A.M., in the
Meeting Room, Department of Liquor control, West Hawaii Civic Center,

Nahale-a: Good morning everyone. I'd like to call this meeting of the County of Hawaii
Liquor Commission to order. As a friendly reminder, please check your mobile devices

Nahale-a: Could the Applicant or representative come forward? Good morning.
Nguyen: Hi, good morning.
Nahale-a: Please identify yourself and your relationship to the business.
Nguyen: Sure. My name is Hyun Jean Nguyen and I am the Owner for Broke Da
Mouth Grindz.
Nahale-a: Are there any changes to the report that you submitted?
Nguyen: No.
Nahale-a: Could you please describe your business for us?
Nguyen: Sure. We're going to be serving local Filipino and Hawaiian food and we're
also wanting to have a bar so it can be paired with our delicious food.
Nahale-a: Thank you. Director, are there any reports of protests?
Takase: Madam Chair, the Applicant mailed out 234 out of 248 notices within 100 feet,
098 out of 739 notices within 500 feet, and seven notices to condominium or co-operative
apartment managers. There were 739 parcels entitled to protest and we received two
protests to this application.

Nahale-a: Thank you. commissioners, the protest letters are in your packet. Is there
any public testimony for this application?
There was no public testimony.
Nahale-a: commissioners?
Raymond: I have a question. In your kind of business, it states that you would like to
have live entertainment in the form of a band or soloist approximately one to two times a
week, and (during) lunch and dinner. Do you have a range of what time this music or
entertainment will be played?
Nguyen: Yes. The reason why I wanted to apply for the live entertainment and band
was as a treat for the customers. Instead of just hearing radio music, I wanted to give
them a little treat and have live music. There's a different feeling (with live music). In
the beginning, we're probably going to have the live entertainment once or twice a
week, but that's just in the beginning to promote our business and to do something nice.
I don't really see having the band consistently. But, back to your question, if we decide
to have live entertainment for lunch, I would probably bring them in during the highest
traffic (period) for not more than two hours. I would probably have them out of there by
maybe 2:00 because that's when lunch slows down; maybe even before then. They
become costly and not to mention, if I have them there too long, the customers won't
get the cue to leave. We plan on closing at 3:30 so that our workers can have a break,
get a chance to eat, and clean up their stations, since it'll get crazy and messy. The bar
will remain open. We'll probably have a small pupu menu, like a happy hour special.
We will actually be serving poke. We have a poke showcase which will be good for
take-out because it's fast, or something that's ready-made; and it's good with beer.
Nguyen: As for dinnertime, like I said, I'm probably going to bring them in during high
traffic dinner time. We close at 9:30, but I don't want the band there until 9:30. 1 actually
would want them out at feast by 8:30 so it gives the customers a cue, you know, like it's
time to go home. I wouldn't want to disrupt our neighbors either. I understand that people
have to sleep, they want their peace and quiet at a certain time, and that's another reason
why we didn't want to stay open any later than 9:30. It still meets the legal curfew time as
far as noise goes. I want to go home, I have family and kids and I also like to sleep, too.
And I want my employees to be able to go home at a decent time because they have
families as well. Not more than an hour and a half, tops two hours is when they'll be
doing the live entertainment. The concept of the restaurant is Itohana." We're all about
having family gather together. People love food and food brings everybody together,
especially families. That is basically our concept and I guess that's it.
Nahale-a: Thank you.
Greenwell: Have you had any conversations with the neighbors?
Nguyen: A couple of them. I guess as soon as the letters were being sent out, a couple
of them actually called my first location and wanted to speak with me. They were
concerned about what type of music I was going to bring in and I told them that if my

servers can't hear the customer placing their order and they're right there, that's going to
be a problem. I let them know that the types of bands or genre that we want to bring in
would be acoustic, ukulele, soft, something chill; none of the drums banging or anything
like that.
Greenwell: In your discussions with them, was that prior to these letters of protest or
after the letters of protest? Do you know off hand?
Nguyen: [ never spoke with these individuals. The person I spoke with never sent in a
letter after I spoke with him. He just wanted more information and I just told him the
truth, what my intention was. He felt better after that. He said he just wanted to know
what kind of live entertainment or band we wanted and what the hours would be.
Greenwell: Thank you.
Salave`a: Madam chair, I have a question.
Nahale-a: ok, we'll hear Claude and then (your question).
onizuka: Being from Kona and familiar with this area, this has been a problem anytime
someone wanted to do something within the resort area. If she's going to close at 9:30,
that's a decent hour. The other thing is, this is not something new. In that area,
you have Huggo's on the Rocks and they put out a lot of music and I can hear that
a mile and a half to two miles away, depending on the wind. Just for the sake of the
Commissioners, I sympathize with the protest letters, but as far as I'm concerned, if you
buy or live within a resort area, music within a certain decent hour comes with that resort
area. I don't think that should be our justification for not granting the license. If you want
peace and quiet, you have to move away from a resort area. That's my opinion.
Nahale-a: Mahalo. Allen?
Salave`a: Thank you. can you tell us what side of the building the music will be played
on, Mauka or Makai?
Nguyen: It will be on the highway side, not where the residentials or condos. are,
because that's where all the windows are, so it's basically on the highway side towards
the hotel side.
Salave`a: Will the music be amplified?
Nguyen: No. I don't want that. Like what I said, if my servers can't hear the customers
placing their order and they're right there, it's going to become a problem. I want the
families to be able to talk across each other and still be able to listen to what they're
talking about.
Salave`a: No plans for, not a concert, but guest band activities?
Nguyen: You mean if they have to pay to come through the door?

Greenwell: a function.
Salave`a: Yes, a function.
Nguyen: I don't think so, because if I'm going to be bringing in a famous band where
the whole Kailua-Kona is going to want to come; I don't think I can afford them to begin
with. I wouldn't really want, no offense, but the really young crowd coming in. I want to
make money for my business, too. I would want a mature crowd that comes in, can pay
for the food, pay for the tab, and be mature and all good. I wouldn't want young 'uns
flocking around my place anyways. It's drama and between my husband and me, we
have six kids together; we're a blended family, and our six kids give me enough drama,
so no thank you.
Ibarra: I have a question. My question is, in your application, you said that you'd like to
have live entertainment approximately one to two times a week. What I'm hearing,
though, is basically you open 11:00 to 3:30 for lunch, 5:09 to 9:30 for dinner. You just
want any amount of time of entertainment during those hours?
Nguyen: To be honest with you, I haven't really figured out if on my first day of grand
opening, if I just want to do lunch band or dinner. It becomes costly, too, if I want to
have it twice a day. I think I just want to have it once a day at the most; and in the
beginning, I'll probably hire them maybe once or twice a week. I haven't really figured
out exactly.
lbarra: But if the Commission grants the application, you would want the flexibility of
going up to 9:00 or 9:30 closing hours or whenever you're open. or are you asking for
a condition or time? Then you can say okay, you got the permit, these are your opening
hours and anytime during those opening hours for any amount of time, the Commission
g ra nted it.
Nguyen: I guess either way it wouldn't matter anyways, because I don't want the band
playing until 9:30 or maybe not even until 9:00. 1 want them out of there by...
Ibarra: And that's why, if it's in the permit, it's clear. Right? You got the permit,
whatever time you're open you can have live entertainment.
Nguyen: Yes.
Ibarra: Versus, if you say to the Commission one or two times a week, you get the
permit, then later on you (continually) increase it. You've already come before the
Commission; are you going to come back? Right now you say one or two times a week.
If you want more than one or two times a week, are you going to come back? What I'm
Saying is why not ask for the whole...
Takase: I think she actually is. When we spoke with them, they're trying to get a
general idea of what their business is going to be like. Typically, we don't restrict them.

It's more of a "this is what I would like" thing. But, until she actually opens and gets a
feel for it, they don't really know. As a Commission, usually, they're not that restrictive
unless there are a lot of complaints about it and they know up front there will be a
problem. We had two protest letters out of 739 (notices that were mailed); that's not a
large amount. Some of the residents are actually here today to listen in. We always
monitor them as well; we always take any complaints if there are any. Up front, I would
not want to say they're restricted to what they...
Ibarra: That's my point. Up front, they might as well ask for the whole ball of wax, so to
speak. So that you'll get more flexibility.
Takase: Yes, their trying to give us a good idea of what they're doing. But, we're not
saying they're restricted to what they have.
Ibarra: And that's all 1 want to know; not coming with one foot in the door, one or two
times for approval and there's nothing on the permit that says one or two times. The
next thing you know, we'll have conflicts. Up front, why don't we just say you're asking
for everything; but as you go along in your business you're going to have to adjust, but
you'll request the whole time.
Nguyen: My goal is to get along with all the neighbors. As long as we communicate,
I'm not hard-headed or stubborn, I'm willing to work with everybody. I'm hoping I don't
have to come back here for any issues. That's my goal.
Takase: If we look at the layout of this place, most of her seating is on the Makai side
of the building. There's not much going up the hill, it's all mostly behind.
Ibarra: I'm not against the permit, I just want to (put it) up front. You've got the
operating hours; I know the area, too, I'm from Kona, you got the road in between the
Kona Mansion and Habaneros, right, the road comes down?
Nguyen: Yeah, the one on the left.
Ibarra: It's just up front, you know? It's in this report here, one or two times a week.
It looks like, okay, it's not that bad, but the Commission relies on this and they might
grant the permit and now you're opening more than one or two times a week. Now
you're opening anytime that you want to introduce live music when you're open. That's
fine with me, I'm in agreement with Claude. But, I just want to put it up front, look, what
you're asking basically is, and in the beginning of a business I can understand you start
small and you may get to the full time when you're open all the time.
Nguyen: Yeah. I understand what you're saying. Basically, am I going for the full pie,
right?
Ibarra: Well, that's what you'll hopefully get in the end, right, if your business is good?
Nguyen: Yeah, yes, but I honestly don't see me hiring bands more than twice a week.
I really don't.

lbarra: And that would be better for your neighbors, right?
Nguyen: Yeah. The last thing I want to do is to take more and try to push, push, push.
But if that ever does happen in the future, I won't just go ahead and do it. I will probably
talk to the neighbors. I actually met the manager for the complex.
Ibarra: I lived in Kona Mansion when I first came back from the mainland, so I know
where the property is. I agree with Claude. It's in a resort area. But I just want to make
sure that it's up front so that the permit is without conditions; whenever you want to do it
during your opening hours versus having litigation in the end. (For example) I heard in
the meeting she said one or two times a week and surrounding people have filed a law
suit, they look at the permit the Commission gave and it's without conditions.
Nguyen: Yeah. My goal is to not let it get to that point.
Nahale-a: It sounds like we have members of the public who would like to provide
testimony now?
Rankin: Aloha, my name is Sally Rankin and I am the president of Kona Mansion's
HOA. We are directly across the street from Broke Da Mouth. Just to start off, we do
appreciate the fact that they've been very open and had a dialogue with us as of today.
Going into this has been scary because we received a notice, but really no information.
Since none of us have experience with going through these permits, you pretty much
leave neighbors hostile coming into this towards somebody we don't know. Let me start
off there because it's kind of hard coming into this.
Rankin: First off, Huggo's, while it is right in that area, we do not hear it from our
location. Ever. I've never once heard it, and I'm on the third floor so I have a direct
sight to it and I don't hear it. Two, while we are technically in a resort area, we are
residential on that side of the street. So, that's not completely fair to say that. We are a
little farther up, we are close to the resort area, but we are zoned residential there. With
wanting to work with them, because we want to be good neighbors, too, absolutely and
we want a successful business there because we've seen a lot of things come and go
over the years; I think what is fair for us to ask is for there to be some conditions so that
we don't go from this, you know. The amount of days is not an issue, but the time in the
evening is an issue. While I think it's fair to say 8:00, 8:30, 1 don't want to see that 9:00,
9:30 pushed, and I'll tell you why. Because while it stops there, it doesn't stop there for
us.
Rankin: (With) the current restaurant that just moved out of there, we could hear the
conversations out of their dishwashing area and where their guys hang out at night and
much later than the time they closed. In talking with her (Nguyen), she's been more
than fair having open communications with us and letting us know what their plans are
and vice versa, but to be fair, we would like to say can we at least be reasonable about
the time of evening that it can go on to so that in the future, it isn't an issue; and we
don't have to come back here. Like I said, we all want to be good neighbors. I think
that's fair to say. We just want to be reasonable at the same time.

Mahoney: And the traffic, too.
Rankin: The traffic, unfortunately, is an issue that we've been dealing with. We've
been having traffic issues there for some time now and we're dealing with the attorney
right now. That is here nor there wherever they have a business or not. The business
was there, we all knew that going into what we bought. We deal with it, that's just life, it
doesn't involve us. Like I said, all we're asking is for everybody to be reasonable about
it. Thank you very much.
Ibarra: In a residential (area), people have parties.
Rankin: No, we have a very strict HOA and we're very vigilant about the people that
live in our building. We have an abnormally high rate of full-time people in our complex
compared to a lot of others that are in that area, especially. We do have issues with a
hostel that has opened across the street from us.
Ibarra: Nobody has music that is played when they have parties? And at what hours...
Rankin: No, we have an extremely strict (policy), and we have a resident manager who
stays pretty tight on that. The only open area we have that you hear noise on our
property is all the way up on Kuakini where our pool and barbeque area is.
Ibarra: So that's where it's allowed as far as your CC&R, or your restrictions?
Rankin: Yeah, if you are going to have a gathering, it's all the way up and it's literally
against the highway. In fact, nobody uses it because it's against the highway.
Ibarra: What time?
Rankin: We have a 9:00 to 9:00 currently on our pool area.
Ibarra: So in that area at least, music is allowed from 9:00 to 9:90?
Rankin: No. We don't allow amplified music. We have a strict rule, basically, we have
a 10:00 P.M. to 7:00 A.M. noise (rule). But in between that, we also have a "respect
your neighbor." So, if somebody is being loud, our property manager can say `hey, one
of the neighbors complained and we can fine you for it.' Like I said, again, we live in an
abnormally high "full-time livers" and a lot of it is because we're affordable.
Nahale-a: Mr. Greenwell, question?
Greenwell: Would there be a possibility of a compromise where they didn't play music
after 9:00?
Rankin: Yes, absolutely. That would make us all happy.
Greenwell: And that would make you all happy?

Rankin: Yes.
Greenwell: So, if they kept on serving up until 9:30 or they kept on feeding people until
9:301 it would not be a problem. It's the music that is the issue?
Rankin: We don't all want to have a concert in our living rooms.
Greenwell: I understand that, but I'm looking for...
Rankin: Yeah, absolutely. I mean, when Habaneros was there they closed at 9:00.
Past that, it generally took them an hour or two to clean up. That was the most brutal
part for us, and that's why going into this with music, and it saying "amplified music"
scared all of us. It scared us all because we're thinking Led Zeppelin's going play and
we're going to have to listen to it; not an ukulele playing and something no more than
what I hear from the Royal Kona now, basically. We hear the Royal Kona directly
across. One thing we will say is, because you said something about the noise, the
complex that is directly next to us and actually across from you (Nguyen), their pool is
right there. Their pool is directly across from the restaurant. It's normally not that noisy
there either. I believe they probably have pretty strict rules on noise, and I never heard
amplified music coming from there. They have a pool house there. The fairness of
9:00, to me, is more than fair. Like I said, I'm all for compromise on it.
Greenwell: I think we need to make a decision as Commissioner Ibarra said, we need
to put a control someplace. If we change this to 9:00 instead of 9:30, and she can keep
it to once or twice (a week), possibly. You say you already have a 9:00 curfew on your
recreation area.
Rankin: Yeah, on our recreational area. On the property, no. We have a 10:00 P.M. to
7:00 A.M. on the property, but our pool is a 9:00 to 9:00.
Nahale-a: Any other Commission questions? We'll hear Mike and then Claude after.
Hughes: Question more for Gerald, I guess. If she's asking for a 9:30 ending time, if
we grant the full open permit to her with no barriers and everything goes well, but all of
a sudden there becomes a problem, the Liquor Commission can still step in and say we
need to do something to curtail the loud music or rowdiness or whatever?
Takase: Correct, we always have the authority to take action against any of the
licensees. She's tried to give you her best guess as to what her business will be like.
We talked to the applicants to try to get an idea of how they're going run it. We didn't
see this as a problem. As for the letters that we received, and I agree in part that
maybe the notices don't explain enough about what the premises would be, but that's
what's required by Statute, we will check if we think there might be problems. If
I thought there would be a bigger problem, we would have tried to bring the two parties
together, but I didn't see this one as being a problem. We have a luxury; she has had a
business in Kona for a long time.
Nguyen: Seven years.

Takase: She has a track record so we know what kind of business she's going to have.
It'll be a little different, yes, but we give them the benefit of the doubt going forward
rather than put restrictions on them from the very start. We will adjust it if it becomes a
problem. We invite them to always call us when there is a problem, and we will work
with them.
Hughes: Thank you. My opinion is we should grant the permit as noted and we
shouldn't be restricting businesses until it becomes an issue, and at that point we
should address it. That's my opinion.
Rankin: We have high hopes that they're going to be good neighbors and from talking
with them, and this is an assumption but we're, I have high hopes that they're going to
be great neighbors.
Hughes: It'll be like she said, communication is key. If there's an issue on their side,
you need to let her know that there's an issue and if she doesn't address it, then that...
Rankin: Yeah. I agree with that and that's more than fair. I think neither one of us
want to be crappy neighbors.
Nguyen: No, not in this town, it's too small.
Rankin: Right?
Nahale-a: Before I continue, I'd like the record to reflect that Commissioner Thomas
has joined us at 10:25 as far as discussion.
Claude: Hearing all the discussion, unless the other Commissioners have any other
objections, I'd like to move that we close public hearing.
Hughes: I'll second that.
Mr. onizuka moved to close the public hearing; seconded by
Mr. Hughes.
Ibarra: I have a question, first. So, (as far as) the protest letter, you represent yourself
or the Association?
Rankin: The Homeowners Association.
Ibarra: How many people?
Rankin: We have 98 units.
lbarra: And everybody is in accordance with your position?
Rankin: We were in a board meeting that we had recently.

lbarra: So you're saying you represent 98 people?
Rankin: we're representing the Homeowners Association coming into this, yes.
lbarra: Which consists of 38?
Rankin: Ninety-eight units, yeah. when we went to our community manager that was
what she suggested we do going into this.
Nahale-a: Anything further?
There was nothing further from the Commissioners.
Nahale-a: If not, it's been moved and seconded.
Thomas: I have one question. Have you had any live music in the other place?
Nguyen: In our current location?
Thomas: Yeah.
Nguyen: No.
Thomas: You haven't. So, do you have any sense for how loud you need your music
to be in order for it to, I mean, the amplification varies and could be a lot because of the
configuration of your space. It looks like it's long and narrow, but I'm just thinking about
the degree of noise that is necessary at all, if you're going to amplify. It doesn't
necessarily, even if you say that your conversation...
Gonzalez: I believe the applicant addressed that earlier. I think she addressed the
applicant about amplification or the housing because the applicant testified that without
anticipating amplification because the servers won't be able to take orders.
Thomas: Yeah, okay.
Nguyen: To be honest with you, I think that if the dining area is full of people, of
customers, the sound of everybody in there talking will overrule or overpower the band.
Right?
Thomas: Yeah, that's what I'm thinking.
Nguyen: If you go in there, there's somewhat of an echo. Honestly, I think the sound
of people talking is going to be louder than the band. That's how I see it.
Thomas: I bring it up because I've been in places that have music and they intentionally
make the music so loud to dampen the (customers' talking), so there's an ambience that
you can orchestrate or determine whether or not you want people to hear themselves
across the table talking or you want the music to dominate. That's something to just be

aware of. You think that it's more important for the diners to hear one another than for
the entertainers to be heard, that's the choice of the restaurant owner.
Nguyen: The kind of ambience we want to create is like what I said, family because
food brings families together and our concept is all about "ohana." Do I want the music
so loud to where they can't even hear each other talk?
Thomas: Yeah.
Nguyen: No, and to the point where servers can't hear what the customers are ordering
or what they're even saying? No. I want everybody in there to be able to have a
conversation without yelling at each other. I want my servers to be able to hear clearly
what the customer wants.
Thomas: Thank you.

live chickens. I'll try to give healthy food to the local people and travelers, too. We will

will serve all food in the morning and lunch times. We don't think (we will serve) so much
at night, just one reservation (customer) at one time at maybe 7:00 (P.M.), 0:00 (A.M.) to
8:30 (P.M.), and we would like to close at 9:00 (P.M.) because we would like to open in the
early morning. We will focus on morning and lunch and serve good chicken and good
eggs, and good local organic vegetables. Thinking about the menu, the bigger organic
people are healthy and energetic. It's all healthy food. We would like to sell healthy
alcohol, too. One hundred percent water and hundred percent rice like sake; hundred
percent water and hundred percent grape is wine; we don't like chemical use. We'd like to
sell water, (for the) future, for the kids.

Dreimann: The primary part of my business is to invest in rarities associated with wine,
held its own, but it expanded to actually take care of some resorts with members to supply
them with wines otherwise not available on a direct basis from a wholesale distributor or
anywhere else. That has now expanded to me providing lectures on wine and differences
of why something may cost more than something else. Finally, this application is to add
liquor, to make it a general wholesaler because this has become more and more successful.
People are coming to find rare tequilas and scotches that, again, are even rarer to find than
some of the wines. While this is not a primary part of the business of investing in wine,
which appreciates in time, it is a service I will provide to the resorts. This is not something
I'm personally interested in; $30,000 bottles of scotch is not what I, whatever I open up and
let evaporate is in my closet. And I'm sorry, just as a sideline to all the conversation here,
the Commission may not have come across (this), but one of the latest things being done by
resorts all over the country is: if there is a curfew for noise, and they can no longer party and
dance after that, a person has now invented and is renting out something called the silent
disco. Some of you may have heard of this, but I think it is totally brilliant. They wear
headphones and only they hear the music. There are three different sets of lights on the
headphones and you dance with someone that matches the light on your headphone so
only the two of you can hear it. You see this whole silent dance floor with people dancing
and there's no noise complaint. I'm always amazed how brilliant people come up with
solutions. So sorry guys, you can no longer complain about noise with silent discos.

Masuda: What is your most expensive bottle now that you're doing spirits as well as
wine?
Dreimann: Well, it's actually, I had'a request to supply a Royal Salute bottle of scotch,
which I couldn't supply. But, I referred them to a local licensed wholesaler who then
delivered it to one of the retailers here, and then they picked it up from the retailer.
That was the $30,000 bottle of scotch. There's only forty of them made in the world and
recently somebody asked for 1800 Coleccion Tequila, and there's again, only forty of them
in the world and this was actually from Bob Parsons. He's famous for CoDaddy (internet
domain), and he wanted twelve bottles. Since there's only forty distributed in the entire
world, finding you twelve bottles is going to be seriously difficult. That order was about
$36,000.
Nahale-a: You were able to find twelve?

Dreimann: I was able to find nine out of the twelve and I told him never to ask me again,
because some came from Scotland, from all over the world and again, went to a retailer.
So that exposed me to a new side that I don't know anything about and don't want to
actually even taste it in case I like it. I have enough vices as it is, it costs too much money.
So that's from a Scotch point of view; but from wine, in California about two months ago,
sold a case of wine for $138,000. That's pretty much my big one this year. For me,
sometimes, I'm very happy if someone invites me to share it with them. The more you
know about wine, the more of a kick it is to find a good wine for a lot less that can come
close, because most of these extremely expensive wines are not necessarily that they're,
they're very good wines, but it's not necessarily value for money, it's about the rarity and
being able to say that you've never had this before and there's very little chance you will
ever find it again.
Nahale-a: Fascinating, always interesting to hear from you.
Dreimann: Well, I see people who collect vintage cars. It's similar to that. Except in this
particular part, as my website will say for people that invest in wine, with a car, you just
need to maintain it, put it into the proper premises and it's always there. With wine, every
time you drink a bottle, the next one is worth more because there's now one less available.
It's not as if you can reproduce it. once it's consumed, it's gone.
