CA -1, Draft 3: Relating to District Residency Requirement Language <br />This proposal was brought forward to correct imprecise language in <br />previous editions of the Charter regarding district residency requirements for <br />members of the County Council and some County boards and commissions. The <br />proposed language more clearly establishes the requirement, if so stated, that a <br />member representing a district be a resident of the district and only that district. <br />CHARTER AMENDMENT NO. <br />BE IT ENACTED BY THE PEOPLE OF THE COUNTY OF HAWAI`I: <br />Section 1. Article III, Section 3-2, of the Hawai`i County Charter (2018 Edition), <br />is amended to read as follows: <br />"Section 3-2. Composition and Terms. <br />There shall be a county council composed of nine members. [One member shall be <br />elected from each of nine districts.] There shall be nine council districts, each of which shall <br />be represented by a resident elected from that district. The terms of the council members <br />shall be two years and shall begin at twelve o'clock meridian on the first Monday of <br />December after their election. The terms of the council members shall not exceed four <br />consecutive two year terms. Candidates shall be elected in accordance with the election laws <br />of the state, insofar as applicable." <br />Section 2. Article III, Section 3-17, of the Hawai`i County Charter (2018 Edition), <br />is amended by amending subsection (c) to read as follows: <br />"(c) Each subsequent redistricting commission shall consist of nine members. [One <br />mcmbcr shall be a resident of each council district] Each of the nine council districts <br />shall be represented by a resident appointed from that district, as established by the <br />previous redistricting commission. The members shall be appointed by the mayor <br />and confirmed by the council in the manner prescribed in Section 13-4." <br />Section 3. Article V, Chapter 2, Section 5-2.2, of the Hawai`i County Charter <br />(2018 Edition), is amended to read as follows: <br />"Section 5-2.2. Cost of Government Commission. <br />For the purpose of carrying out the policy set forth herein the mayor with the approval <br />of the council shall appoint a cost of government commission consisting of nine members. <br />[One member shall be a resident of each council district.] Each of the nine council districts <br />shall be represented by a resident appointed from that district.
