Mr. Goodenow: I just kind of one related question... following up on it ... so the <br />petition ... who has access to the redacted petition prior to the <br />hearing before it comes before the board ... how's that distributed? <br />Mr. Yoshimoto: The petition is sent to the respondent... redacted. <br />Mr. Goodenow: Right and ... only to the respondent pretty much.. <br />Mr. Yoshimoto: Yes. <br />Mr. Goodenow: I guess and then of course us. <br />Mr. Yoshimoto: Yes. <br />Mr. Goodenow: The first one we get is redacted. <br />Mr. Yoshimoto: Yes. <br />Mr. Goodenow: So ... well that's ... I mean the point of that I assume is because ... so <br />they can come and you know respond ... but would there be <br />anything if we put it in the rules to say ... that the respondent... their <br />response would be provided to the petitioner as soon as it's <br />received ... I mean we could do that don't we... <br />Mr. Yoshimoto: That would be a rule clarification that could clear up that area if <br />the board decides to do so... <br />Mr. Goodenow: That does seem to be a really good point on that part ... I'd agree <br />with that. <br />Ms. Kahakalau: I'm also in agreement with that I mean again transparency you <br />know the more that the various parties know about the issue and <br />the better everybody's informed ... I think that's always a plus so <br />that's my personal opinion and do we have any other opinions <br />from board members in regards to that particular issue which <br />would be ... as we're looking at amending the rule change ... or <br />amending our rules that we consider and that we at least put it on <br />our agenda to look at this ... that aspect of discovery in terms of a <br />petition and the response to the petition also going to the petitioner <br />rather than you know ... only being available at the date of the <br />hearing. <br />Mr. Robinson: Madame Chair if I could just ... instead of the broader issue I'd like <br />to ask specifically Mr. Tucker ... I remember your hearing and the <br />information you presented... was in the course of that were you <br />13 <br />
