Ethics and so we did have Mr. Adams you know working on <br />changes to the rules and I am in the process of communicating with <br />him in regards to that effort ... so we do recognize the need to <br />review and to update and to change if things aren't working for the <br />public you. know because this is not about us ... this is obviously <br />about the public so as I said'we appreciate that ... and so I think as <br />far as the first part ... were ... it has been noted in terms of us <br />discussing that matter further ... and figuring out how we can either <br />waive confidentiality or change the rules to allow for that response <br />to go to the petitioner as well ... so that will be on a future agenda <br />when we specifically address the rule changes ... so we're <br />good ... are we good on that as far as you're concerned? <br />Mr. Tucker: As far as discussion goes... <br />Ms. Kahakalau: Yeah. <br />Mr. Tucker: Yes. <br />Ms. Kahakalau: Okay... alright... and then the second I guess kind of an issue was <br />the whole cross-examination piece ... that's my opinion ... and <br />so ... we want to talk about that a little bit for clarification ... Mr. <br />Goodenow. <br />Mr. Goodenow: I have a question:..you know I asked Mr. Tucker what kind of <br />notice he received ... I mean ... you know I know in a court room <br />people are expected to know the rules and the laws but you know <br />we're different ... we're really a board here that's setup right I mean <br />to serve the public and you know the confidence and ethics and <br />you know I want to make sure that even if legally we.. -.may be <br />alright ... it was an informal hearing ... you know it was completely <br />different setup if you weren't really aware of that and what you're <br />options were ... that's concerning to me ... I'm wondering for J what <br />do ... do we send the petitioners any -kind of little letter about what <br />you know the ... refer to the rules you know and you look up the <br />rules and this is our procedure ... it's an informal hearing ... the <br />board first decides what they can do ... they can either do this ... this <br />or that ... right I mean ... do we send anything out? <br />Mr. Yoshimoto: No ... they would just basically receive the letter acknowledging <br />receipt of their petition and notifying them of the hearing date. <br />15 <br />
