Comments? <br /> <br />CARR SMITH: Chairman, I’d like to move— <br /> <br />UNGER: Let me, let me – thank you, you may be seated. <br /> <br />CARR SMITH: I move that the Commission enter into executive session to consult with its <br />attorney regarding questions and issues pertaining to the Commission’s powers, duties, privileges, <br />immunities, and liabilities pursuant to HRS 92-5. <br /> <br />SHIMAOKA: I second. <br /> <br />UNGER: Motion by Commissioner Carr Smith, second by Commissioner Shimaoka. All in <br />favor? <br /> <br />COMMISSIONERS: Aye. <br /> <br />UNGER: Opposed? \[None.\] Motion moves unanimously. We are in executive session. If we <br />could ask the members of the public to leave the room. And we will reconvene shortly. Thank <br />you. <br /> <br />Chairman Unger called a short recess at 12:30 p.m. and the room was cleared. The Commission <br />went into executive session at 12:33 p.m. for the purpose of consulting with its counsel regarding <br />questions and issues pertaining to the Commission’s powers, duties, privileges, immunities, and <br />liabilities, pursuant to Hawai‘i Revised Statutes 92-5. Commissioner Shimaoka left the meeting at <br />this time. <br /> <br />At 12:41 p.m. it was moved by Commissioner Church and seconded by Commissioner Vitousek <br />that the Commission go out of executive session. Upon a voice vote, the motion carried <br />unanimously. The meeting was reconvened at 12:43 p.m. <br /> <br />UNGER: The hearing is back in order. Commissioners, I need a motion on the agenda item. <br /> <br />VITOUSEK: Prior to making a motion, will it be possible to ask a follow-up question— <br /> <br />UNGER: Sure. <br /> <br />VITOUSEK: —for the Planning staff? I’m just curious about, you know, I made a couple of <br />recommendations today, how that could be included in what goes forward to the County Council. <br /> <br />UNGER: I would say, and I can take a, I can make a suggestion; you can, if you want to make a <br />motion, you make it part of the motion. <br /> <br />23 <br />EXHIBIT B <br /> <br />
