of interest with regard to the ethics code. It says that when there is <br />a substantial personal interest that Council members make <br />disclosures before voting. They're not told to be recused. They're <br />told to simply make a disclosure before voting. In taking a look at <br />the Council rules number 11, it asks Councilmembers to submit a <br />disclosure and recuse themselves with personal... substantial <br />personal interest. And to be very clear and to delineate this. There <br />was a matter that came before the Council with regard to an <br />arbitration agreement for the Hawai`i Firefighters Association. My <br />partner is firefighter. And so I issued a written disclosure before <br />the finance committee and verbally disclosed for the record at <br />committee and at Council that my partner was a firefighter. Even <br />at that point, Council Chair Aaron Chung noted that he wished that <br />I voted. But in checking with corporation counsel, they asked me <br />to err on side of caution to issue the written disclosure and to <br />recuse myself just to be on the safe side. Chair Chung did not <br />seem to think that there was a substantial personal interest but <br />allowed me to recuse myself from the vote anyway. It <br />says upon a receipt of request, the board may render its opinion on <br />the basis of the information available or may request additional <br />information or follow the hearing process. You don't need to <br />submit evidence but at this point I'm going to ask the petitioner if <br />they have any witnesses or evidence they wish to present to us at <br />this time. <br />We submitted I think everything we have...enough paper already. <br />And now same.
