The meeting was called to order by chair Shelby Nahale-a at 10:00 A.M., in the
Meeting Room, Department of Liquor Control, West Hawaii Civic Center,
74-5044 Ane Keohokalole Highway, Building B, 2nd Floor, Kailua-Kona, Hawaii.
The following were present and constituted a quorum:

Nahale-a: Good morning everyone. I'd like to call the meeting of the County of Hawaii
Liquor commission to order. If everyone could please place your cell phones or any
other devices on silent we would appreciate it. A couple of housekeeping things: we are
recording this meeting so please remember to speak one at a time so that the recording
remains clear; the microphones in the room do not amplify your voice but only record
what is being said. Can we start by going around the room and introducing ourselves,

Nahale-a: We have an addendum to this agenda. Pursuant to Section 92-7, Hawaii
Revised Statutes, as amended, Items 1 and 2 are the proposed amendments to the
agenda and have been determined not to be of reasonably major significance nor do
they affect a significant number of persons, and are proposed for placement on the
agenda by two-thirds vote of the commission.
I. New Business, ADD Item No. 19:
19. Italian Restaurant #2, LLC, dba Romano's Macaroni Grill,
ratification of Management Agreement, effective July 23, 2019,
with RMG Development, a Delaware limited liability company,
approved by Director Gerald Takase on July 25, 2019, to its
Restaurant General liquor license, category B1, located at
the Queen's Marketplace, 09-201 Waikoloa Beach Drive,

Finn: No, it links to the motion you're about to hear.
Takase: If I may explain what's going on here, in items 5, 0 and 7, you'll see a reduction
of Daylight Mind's premises. For those of you that are familiar, it's the old Charthouse
location on Alii Drive. Right now they have a downstairs and an upstairs. They are
going to reduce the upstairs portion, which you will see coming up in number 7, and lease
that portion out to Papa Kona Coffee & Events. Right now, for number 5, they're asking
for a reduction of their licensed premises, which is the entire second floor. Secondly,
they're asking for a change in class. This is for Daylight Mind from a Dispenser General
to a Restaurant license, and they do meet the 30 percent food sales (requirement). Then
finally number 7, which would be a different licensee coming up, they will be asking to
take over the upper portion as a caterer.
Ibarra: Question, Gerald, (it's) a reduction of the entire second floor, not a splitting of that
second floor?
Takase: The new licensee will come in and take over the whole second floor of Daylight
Mind's area.
Greenwell: Are we going to take the approval of (numbers) 5 and 6 together?

Shropshire: obviously, food is our primary thing, so it's supplemental. We're going to do
high-end cocktails or high-end micro brews; more on the upper scale kind of thing. We're
not really looking to start serving a bunch of alcohol. It's more to add to the overall vibe,
guess.

Domingo: My name is Kilohana Domingo from Kalaekilohana Inn & Retreat in Ka`u.
Nahale-a: Thank you. Are there any changes to the report?
Joyce: No.
Domingo: No.
Nahale-a: Could you briefly describe your business for us?
Joyce: The County classifies us as a lodge and we operate in that way. We have
a commercial kitchen and we just received permission to open, to the general public,
a farm to table restaurant.
Nahale-a: Thank you. Any public testimony?
There was no public testimony.
Nahale-a: Seeing none, Commissioners, discussion or questions of applicant?
Greenwell: Yes, kind of unique. I didn't know of any bed and breakfast or lodge or
anything down in that area. Is it something that you are evolving into? Was it an old
house you modified?
Joyce: We actually built the building between 2002 and 2005 with the purpose of doing
what we're going to be doing here now. We went back to the County to amend our
special use permit a few years back to re -categorize ourselves as a lodge. We
originally opened as a bed and breakfast because that was in the parameters of what
we were capable of at the time.
Greenwell: Kind of unique being out there, far away from the rest of the country, the
world.
Joyce: It's very unique. We may be just one of a couple of properties that have our
designation and so far, it's been good for Ka`u.
Greenwell: Thank you.
Arakaki: So what designates you as lodge versus a bed and breakfast? Is it the
number of bedrooms?
Joyce: our special use permit.
Arakaki: Does it have to do with the size of your building or number of people in it?
Joyce: No, not really. I think it's just the designation the county gave us when we went
back through the special use permitting process.

Nahale-a: It looks like a pretty large property as a whole? I see that you have the ability
to accommodate private functions at the property.
Joyce: Right, that's part of our permit.
Domingo: our permit allows us to do, if we wanted to, one special event a month. We
haven't really done very many of those, maybe six.
Nahale-a: It looks like your neighbors are probably far.
Domingo: It's a three -acre property. All of the parcels adjacent to us are three -acre
parcels.
Arakaki: How far from South Point are you?
Joyce: We're 11 U.S. miles to the point.
Arakaki: So you're up on top?
Joyce: Yes, we're one mile off the highway.
