of the Liquor Commission to order. A couple of housekeeping notes: please keep your cell
phones on silent. We're recording the meeting, so please remember a couple of things.
Speak one at a time so that the recording remains clear and the microphones in the room do
not amplify voices, they just record what is being said. Let us introduce ourselves, please.

Potter: Good morning. My name's Adam Potter and I'm one of the owners of Puna
Chocolate Company.

Nahale-a: Briefly describe your business, please.
Potter: Sure. We started Puna Chocolate Company in 2012, on a cocoa farm in Pahoa.
We grow all of our cocoa beans and buy cocoa bean from Big Island farmers. We make
our own chocolate. In Kona, we built a site where we want to do cocoa chocolate infused

cocktails as well. We wouldn't just use the chocolate that we use for dessert, but also use
the pulp and juice.

Takase: Madam Chairman, the applicant mailed 16 out of 16 notices within 100 feet,
244 out of 249 within 500 feet, and one notice to a condominium or cooperative property
manager. There were 127 properties entitled to protest and we have no protests to the
application.

on food. We'II have breakfast and lunch bento and an evening take-out buffet. We're
looking to open as soon as possible, meaning by late October.
Nahale-a: Wonderful, thank you. Mr. Director, any reports of protests?
Takase: Madam Chairman, the applicant mailed 11 out of 12 notices within 100 feet, and
67 out of 72 within 500 feet. There were 72 properties entitled to protest and there were
no protests to this application.

Greenwell: I guess the Police Department is going to control, they have special police
on duty?

Takase: They applied with and received a permit to close the street for their
celebration.
Greenwell: Our enforcement doesn't have anything to do out there on the street? It
would be HPD?
Takase: No. They're having a 50th anniversary party and are asking for an increase for
the roadway portion and that triangular piece across the street. We still have enforcement
over all the areas. As much as possible, they're not going to allow drinking on the street.
They'll probably have people going back and forth in that area.
Ibarra: So, there's different agencies involved in enforcement. Liquor Control is
responsible for the liquor licenses and laws and rules. Police will be responsible for the
traffic.
Takase: I believe between Police and Public Works, they're going to block off the street
for that time. They're not going to be directing traffic there.
Greenwell: Okay.

Takase: Basically, he says that he has been working with the State tax office. He
thought his CPA was taking care of it, but found out that they weren't doing anything.
He's hired a new CPA who's trying to get him out of this mess and get everything
straightened out. Hopefully, he will have everything done in several weeks from now.
Currently, he is operating as a bar, but we have not approved him yet for his Cabaret
license until he brings everything into compliance.

that we're not saying one way or the other, that there's gambling or no gambling. That
should be left to the Prosecutors or the appropriate authorities.

Takase: In Pancho and Lefty's case, they are moving from their current location to
across the alleyway. His landlord requested them to move, but the landlord has also
been delinquent in finishing any of the improvements that are needed for them to move.
We have no problem with what he's doing and since it's right across the alleyway,
there's really nothing much changing to impact that area. We have no objections.

Ibarra: Again, we've been making motions to approve with good cause. I want the
record to show that although we're not stating what the good cause is on the record, the
good cause is supported by the letter or the exhibit in the file.

Greenwell: Gerald, does the Building Department (and/or) the Planning Department
get involved in this move?
Takase: They would have to approve the improvements to the new facility. They're
trying to put a kitchen in, so they'll go through the whole nine yards with building,
plumbing, electrical, fire.
Greenwell: Just for our advice, if they come back in six months and they still aren't
ready to go, do we give them a second extension? I realize we're looking down the
road, but...
Takase: Yes, again, it's up to the Commission. I would say if they have any start of
construction by then, I would be in favor of granting that. He's stuck because he's
moving, but he doesn't have control over the movement. It's his landlord who's
supposed to be doing it. He's trying to get the landlord to move things along, but the
landlord is saying he could open in the old place. The landlord's not really recognizing

that he already applied and got the license for the new place and he needs to do
something. That's where we're at.
Takase: I was having a discussion with Brandon this morning about, maybe with the
way things go, one year may not be a sufficient amount of time for a lot of these entities.
They always come in for the liquor license first because they want to know they can
either get a liquor license because I believe that's what the bank will require for the
financing. They come early on to get that and everything else starts to happen after
that. If they're ready to go, they can start right away. If they don't need financing, they
can go right away. But, other than that, everything drags.
Takase: For those of you who are business people, you can understand that although
we like to think that the County works efficiently, sometimes we don't. I'm loathe to ding
the Licensees because a lot of times it's a separate County agency that's holding them
up. On one hand we're saying `go, go, go,' and the other ones are moving at their own
pace. I would hate to deny someone's license on that basis that they were trying to
move ahead, and they're caught between a rock and a hard place; but they're being
held up by the other departments and we don't have control over the other departments.
Once I see that we start to have some motion, not that they're sitting out there not doing
anything, then usually we would support granting them those continuances.
Ibarra: It's a case by case basis. Sometimes you'll have people that just sit on it and
they're not doing anything. Whereas...
Takase: Right. We've had those, too, and we'll tell them that we're not going to
recommend extensions for you and that will end it. Most of them that we feel there's
at least some basis for it, we will allow it to come forward to the Commission, and
recommend support in those cases.
