3. Janice Palma-Glennie, representing herself, testified on Bill 87, Kona CDP Amendments. She <br />asked Councilmembers to muster the political will to implement the financing plan and <br />generally contribute to the plans implementation through the budget. She asked that the <br />amendments pertaining to landscaping be reassessed carefully. She generally sought for <br />alignment between the Kona CDP and the County Code and better educational outreach on <br />behalf of the County. She expressed concern for unplanned development and a hope that we <br />do not allow for that to continue in the future for the Kona Community. <br />40 Dwight Vicente, representing the Hawaiian Kingdom, testified in opposition to Bill 87, Kona CDP <br />Amendments. He expressed that lands referenced in the CDP still belong to the Hawaiian <br />Kingdom and that the County has no jurisdiction. <br />4- Business: <br />1. County Council's Public Meeting Regarding Planning Director Initiated Amendments to the Kona <br />Community Development Plan (KCDP). <br />A complete video of this meeting is available to view on the County Council website: <br />http://hawaiicounty.granicus.com/ViewPublisher.php?view id=1 <br />This meeting was a concurrent County Council meeting and a Kona Community Development Plan <br />Action Committee meeting to abide by the Sunshine Law (HRS Chapter 92) and enable the CDP Action <br />Committee members to attend and provide comments to the County Council. The purpose was to <br />determine passage of the Kona Community Development Plan Amendments on its first reading before <br />County Council. Members of the Kona CDP Action Committee attended this meeting and were able to <br />testify and answer questions from County Council Members. <br />Councilmember Kierkiewicz moved to approve Bill 87 on its first reading. Second by Councilmember <br />Richards. r <br />Councilmember Kierkiewicz moved to amend Bill 87 with the contents of Communication <br />Number 352.011. Second by Councilmember Eoff <br />This additional amendment [AC Communication Number 2019-23] may be viewed and <br />downloaded from the following website: <br />http://records.hawaiicounty.gov/Weblink/1/doc/101407/Pagel.aspx <br />Planner Plunkett explained that this proposed amendment to Policy LU -3.4 was intended to <br />uphold the highest level of environmental protection in the plan while mitigating any possible <br />legal conflicts. He explained that this policy would ensure that applications would still be <br />subject to review based on the Clustered Rural Subdivision Guidelines and that it would not be <br />only at the applicant's option. <br />Councilmembers thanked planning staff for being diligent in checking for any issues or <br />inconsistencies with the proposed amendments. Councilmember Richards asked for an <br />example of what might have occurred if the amendment was not altered in this way. <br />Planner Plunkett explained that the policy addresses everything which falls outside of what the <br />plan designates as the Kona urban area. By making the policy at the applicant's option as was <br />originally proposed, it would create the potential for applicants to disregard the clustered rural <br />subdivision guidelines that the policy originally called for.
