And I think <br />4 <br />that's what became this very serious concern for us, <br />5 <br />when this County was going through the issue of merit <br />6 <br />principle in the civil service system. <br />7 <br />So I think, given all of that, I would really <br />8 <br />hope that the MAB would choose to look at this case and <br />9 <br />see whether, in fact, the people who made the decision <br />10 <br />in this situation were following the merit principle <br />11 <br />because, I think, as I said, when I reviewed it, I had <br />12 <br />very serious doubts about this particular situation <br />13 <br />where this career employee has not been given the <br />14 <br />opportunities that she should have. <br />15 <br />Now, I grant you anytime the employer says <br />16 <br />the employee can't perform the job, has not been <br />17 <br />performing the job, that's a completely different <br />18 <br />story; but barring that, I think that's the <br />19 <br />responsibility of every jurisdiction in the State of <br />20 <br />Hawai ʻ i to look at the merit principle.
