I'm also one of the Investigators from <br />2 <br />the prosecutor's office. <br />3 <br />CHAIR NAHUINA: Thank you very much. <br />4 <br />This hearing is appeals filed by Mr. Clement <br />5 <br />Guzman, Mr. Kelly Mayne, and Mr. Danny Pang at the Merit <br />6 <br />Appeals Board meeting held on September 27th, 2017. <br />7 <br />These three appeals were consolidated with no objection <br />8 <br />from the parties. <br />9 <br />The issue in this case has been identified as <br />10 <br />did Employer, the Office of the Prosecuting Attorney, <br />11 <br />and the County of Hawai ʻ i violate any statutes, <br />12 <br />regulations, rules, or personnel policies regarding <br />13 <br />their recruitment and examination actions concerning <br />14 <br />their interview and selection procedures/process? If <br />15 <br />the answer to the above is "Yes," then what remedy can <br />16 <br />be awarded by the Merit Appeals Board? <br />17 <br />The Board is in receipt of communication by <br />18 <br />the County, Communication No. 17-04.07, to discuss the <br />19 <br />motion to dismiss for lack of jurisdiction. We will <br />20 <br />take this matter up first. <br />21 <br />Are the parties prepared to proceed at this <br />22 <br />time? <br />23 <br />MR. MUKAI: Yes. <br />24 <br />MS.
