Schoen: So based upon there being no previous violations, the license was issued in 2015, and the Licensee did, even though they're not here, they did take responsibility for the violations. We are recommending as to Count 1, a $2,000 fine with $1,000 suspended for one year from the date of the service of the Decision and Order, on condition that there be no similar sale to minor violations, and that $1,000 be paid within thirty (30) days upon receipt of the Decision and Order, made payable to the Department of Liquor Control. Schoen: For Count 2, $1,000 fine with $500 suspended for one year from the date of service of the Decision and Order, on the condition that there be no similar Rule 5-2 violations, being person in active charge; and that $500 be paid within thirty (30) days upon receipt of the Decision and Order. Giffin: Board, are there any questions that you would like to ask Ms. Schoen regarding Count 1 and/or Count 2? Taniguchi: I have a question on Count 2. Giffin: All right. Taniguchi: In reading this, I think he was the only one that was authorized. Is that what it was? Gonzalez: She was scheduled to take the liquor card class that week.
