The room was cleared and the Commission went into executive sessional 10:42 a.m.for the <br /> purpose of consulting with its counsel regarding questions and issues pertaining to the <br /> Commission's powers, duties,privileges, immunities, and liabilities,pursuant to Hawai`i <br /> Revised Statutes 92-5. <br /> At 11:04 a.m. it was moved by Commissioner Kealoha and seconded by Commissioner Yates that <br /> the Commission go out of executive session. Upon a voice vote, the motion carried with all in <br /> favor. Chairman Unger called a short recess. The meeting was reconvened at 11:08 a.m. <br /> UNGER: We'd like to invite the petitioners backup. The Commission had some questions, so <br /> if Mr. Alaoh, I'm sorry, I'm sorry the, the petitioners, yeah, Mr. Alapai and Ms. McMichael. <br /> If you can come up, the Commission, Commissioners had some additional questions for you. <br /> Thank you. Commissioners? <br /> KEALOHA: I'd like to ask the petitioners who is actually filing the petition? My understanding <br /> is it's under the Surf Rider Foundation? <br /> P. MCMICHAEL: No, West Hawaii Surfing Association. <br /> KEALOHA: Association. <br /> P. MCMICHAEL: Mm-hmm. We're both on it. <br /> KEALOHA: You are both members of the association? <br /> P. MCMICHAEL: Correct. <br /> VITOUSEK: So, again, our understanding is that in these cases where there is an association <br /> being represented that there be one person selected by that association to represent the interests <br /> of the association. Is that something that you guys would like to do? Designate one person to <br /> represent the interests? Or, would you rather file separate? <br /> ALAPAL Ask the boss.
