YEE: I think, candidly, we see a trend with a lot of developers inquiring about 201H as a way to <br /> try to get around certain zoning or certain ordinances, certain rules. And so we've been <br /> messaging to developers that, you know, we still have purview over, you know, safe standards <br /> and stuff like that, so you can't just do whatever you want on water, sewer issues, that you can't <br /> exempt everything. But it's not generally totally well-defined yet. So I would say in more <br /> recent time, and the trend has only been in the last couple years since I've been here where we <br /> are trying to feel out where we stand, we have been pushing the State for more comments around <br /> where they see this line. I think internally we've had deep conversations with Office of Housing <br /> to make sure that we try to stay on the same page as much as possible. Obviously, they have a <br /> mission to want to have more affordable housing, but we have to find the balance between <br /> having affordable housing and what are some tradeoffs possibly then to get that that may go over <br /> a line, too. So I think it's a work in progress for sure. <br /> CARR SMITH: Thank you. <br /> JACKSON: Commissioner Carr Smith, Jeff just reminded me, too, that it's not just private <br /> developers that use the 201H process; a lot of non-profits also work with Housing and provide up <br /> to a hundred percent affordable housing through the 201H process. <br /> UNGER: Commissioner Vitousek. <br /> VITOUSEK: Thank you. My question was just on the 50 percent affordable housing. Is that <br /> specified in the 201H regulation? <br /> JACKSON: Yes, that's the minimum requirement. <br /> UNGER: Then to clarify, we are going to have the hearing first on the petition for standing. So <br /> it sounds like whether that is granted or denied, it sounds like the Commission will not be ruling <br /> on and not be making a motion on either Agenda Item No. 1 or 2. Is that correct? <br /> JACKSON: That's correct. The Director wouldn't have a recommendation until the application <br /> is revised. <br /> UNGER: Okay, great, okay, so, technically, what is the status of the application—and we'll talk <br /> to the applicant also —but, is your understanding that it's deferred at this point or withdrawn? <br /> JACKSON: It's not withdrawn; it's on hold until the revision comes in. <br /> UNGER: Okay, okay, thank you. <br /> JACKSON: And my understanding from the applicant, they just emailed yesterday and said that <br /> they hoped to get it to us next week. <br /> 5 <br /> EXHIBIT A <br />
