ADMINISTRATION § 2-238 <br /> "Sponsorship agreement" means a written agreement executed between the County <br /> and sponsor governing a sponsorship, on terms and conditions acceptable to the County <br /> and the sponsor. A sponsorship agreement may include provisions that allow for the <br /> recognition of the sponsor. <br /> "Sponsorship recognition" means a tangible acknowledgment and expression of <br /> gratitude issued as part of the sponsorship agreement. <br /> (2018, ord 18-32, sec 2.) <br /> Section 2-239. Commercial sponsorships. <br /> (a) In accordance with the provisions of this article, executive agencies of the County <br /> may accept contributions valued in an amount no less than $20,000, from sponsors <br /> in exchange for sponsor recognition. This article and sponsorship agreements <br /> entered into pursuant to this article, shall be implemented and executed in <br /> accordance with all applicable laws, including chapter 89, Hawai`i Revised <br /> Statutes. <br /> (b) The following sponsorships shall not be allowed: <br /> (1) Sponsorships with persons that practice or promote discrimination based on <br /> race, color, creed, religion, gender, including gender identity and expression, <br /> sexual orientation, age, marital status, ancestry, national origin, or disability; <br /> (2) Sponsorships with persons that have a pending open application with the <br /> County for a discretionary approval; or <br /> (3) Sponsorships with persons opposing the County in a pending or ongoing legal <br /> proceeding. <br /> (2018, ord 18-32, sec 2.) <br /> Section 2-240. Exclusions. <br /> This article does not apply to: <br /> (1) Gifts, grants, or donations accepted pursuant to article 30 of this chapter, <br /> where no sponsorship agreement exists or is required; <br /> (2) Naming of facilities pursuant to chapter 15, article 8; and <br /> (3) Events sponsored or co-sponsored by the County pursuant to other ordinances <br /> or rules. <br /> (2018, ord 18-32, sec 2.) <br /> Section 2-241. Sponsorship agreement. <br /> (a) The County possesses sole and final decision-making authority for determining the <br /> appropriateness of a sponsorship and reserves the right to refuse to enter into any <br /> proposed sponsorship agreement. <br /> (b) The administrative head of a County department, office, or agency, with the <br /> concurrence of the director of finance, shall have the authority to negotiate a <br /> sponsorship agreement, for a contribution valued in an amount no less than <br /> $20,000. <br /> (c) Each sponsorship agreement must specify whether the sponsorship for a particular <br /> asset will be exclusive or non-exclusive. All sponsorship agreements must be <br /> authorized by the council by resolution and signed by the mayor. <br /> 2-103 SUPP. 7 (1-2020) <br />
