I. Call To Order
The meeting was called to order by Chair Shelby Nahale-a at 10:01 A.M., in the
Meeting Room, Department of Liquor Control, West Hawaii Civic Center,
74-5044 Ane Keohokalole Highway, Building B, 2nd Floor, Kailua-Kona, Hawaii.
The following were present and constituted a quorum:

Commission to order. As a reminder, please place your cell phones on vibrate or silent.
Just for housekeeping, we are recording the meeting. That's what the microphones are
for. Speak one at a time and clearly so that we can get an accurate recording of the
meeting. The microphones do not amplify your voice, so don't worry about trying to

II. Approval of Minutes
Nahale-a: The November 7, 2019, meeting minutes are still being prepared, so we'll
move on to Approval of Addendum or Supplemental Agenda.
III. Approval of Addendum and/or Supplemental Agenda (10:02 A.M.)
Nahale-a: We have an addendum to the agenda.
Pursuant to Section 92-7, Hawai'i Revised Statutes, as amended, Item 1 is the
proposed amendment to the agenda and has been determined not to be of
reasonably major significance nor does it affect a significant number of persons,
and are proposed for placement on the agenda by a two-thirds vote of the
Commission.
1. New Business, ADD Item No. 13:
13. Wong Yuen Store LLC, dba Wong Yuen Store,
pursuant to Rule 4-2-M of the Rules and Regulations
of the Liquor Commission of the Department of Liquor
Control of the County of Hawaii, State of Hawaii,
requests approval to extend the time issuance of its
Retail General Liquor license, for an additional six
months, from December 6, 2019, to and including
June 6, 2020, by letter dated November 27, 2019.

Ueoka: This is for a general Retail liquor license for a standard grocery store. We also
have a restaurant license that is the next application on the agenda. We're just a standard
store and we're actually going to call it Malama Market Pahoa and we will submit the
Malama Market Pahoa tradename documentation.
Nahale-a: Thank you. Mr. Director, are there any reports of protest?
Takase: Madam Chairman, the applicant mailed 4 out of 4 notices within 100 feet, 10
out of 10 notices within 500 feet. There were 9 properties entitled to protest and we
have no protests to this application.

Bodien: Kokoiki Brands will soon own Hawaii Cigar & Ukulele and CBD.Center and
Mother's Cigars. It's all housed under one roof in the Kohala Trade Center in Haw7.

continue their liquor license until October. If these people are taking over, Lamonts
does not have any operation there?
Takase: It was this past October. (to the applicant) You've already taken over?
Obina: Yes, we've already moved in as of November 8th.
Greenwell: Lamonts has terminated their license?
Takase: Yes.
Greenwell: So it's canceled?
Takase: Cancelled. I don't know all the logistics of how they went about it, but they are
the successor shop in there.
Greenwell: Okay.
Nahale-a: The report is from September, so at that time, they hadn't yet canceled their
liquor license.
Greenwell: Okay.

Yoneyama: Okay, Yasuhiro has been in operation for the last six to seven months
without a liquor license in Kea'au Shopping Center. The premises consists of approximately
1,700 square feet of kitchen and dining area downstairs, with a little, short of 200 square
feet, loft which is going to be used strictly for storage. Customers are not allowed there.
This is not a full-service restaurant. All customers must go to the cashier and pay first, and
will be called when their meal is prepared so they can pick it up. They can dine there if they
wish. Besides sushi, they have some noodle dishes available; but again, it is not a
full-service restaurant.
Yoneyama: Upon obtaining a liquor license, customers must go to the cashier and pay
first and they will receive either bottles or cans of beer which they have to consume on
the premises. There are some buffet trays at the entrance, but that area is excluded
from this business operation, to make it clear. They have done no renovations and the
business will be operated from 11:00 A.M. to 7:00 P.M. and they may consider up to
8:00 P.M. upon obtaining the liquor license.

Takase: For a bit of background, Dragon Roll, you saw Amanda had just come in, she
is taking over from Shimaichi's which is in the old Bank of Hawaii building. Dragon Roll
owned that one. He's selling that one to Amanda, who's been the Manager for a long
time. He has, in turn, opened this other one in Kea'au. He also owns Tunaichi, which is
under Gertrude's Jazz Bar. He has been in Hawaii for a while and he's been our
Licensee as well for a while under Shimaichi. He's just moving his operation to Kea'au
now.
Hughes: Gerald, a question for you. She stated that they pay for food and drink and
then they receive it. How do they assure that those drinks stay in the licensed premises?
The reason I ask is Kea'au Shopping Center has a lot of homeless people and drifters,
and I just wonder how they'd keep the alcohol in the establishment and prevent it from
leaving.
Takase: We'll have to speak with the owner when he comes in about how they're going
to do that.
Yoneyama: They have one entrance, one small entrance in front, if you inspect the
site...
Takase: It's the old Charley's location, which used to be open-aired; but they've enclosed
most of it, so now it's just the doorway they have to man or keep an eye on, or...we'll
work with them on that. I'm not so worried about the homeless getting the liquor, but
more that it sounds like it's going to be a self-service place. We'll have to work with them
on how they are going to police that.
Greenwell: Gerald, Mike brings up a good point. Pay first, so is there a limitation on how
much they can buy?
Takase: Well, typically they can only buy two at a time.
Greenwell: Because they're paying first, they can buy two at a time?
Takase: Yes. I don't know that...we're going to have to speak with them about the liquor
service. It's not that big of a place that they can't watch the whole place, but since, from
what Miho is describing, it's more like self-service (where) you go to the counter and get
your stuff.
Greenwell: Right, so what Mike brought up was once they've bought their alcohol, they
can walk with it. And the thought they're going to have is 'it's mine, I can walk with it
now.'
Takase: No, so they'll have to police their door. We have other situations, like Maui
Tacos in the Prince Kuhio Mall, where they receive their drinks from the window; but
they've cordoned off an area where they can consume, and it's up to them to watch that,
to make sure people don't walk out with their drinks.

Takase: Commissioners if you remember, the applicant, Eric Kim, appeared at the October
meeting and we had questions about where he was and what he was doing in terms of
getting all of his permits and construction done. I think it (turned) out that he didn't have his
permits done and he has since asked us to withdraw his application.
Nahale-a: Okay.
Hughes: Is he able to reapply?
Takase: He can reapply. If he gets denied, then there would be a one-year stay on the
property; but since he got his license and he didn't finish the process, he could reapply and
we would deal with it as it comes. I don't know what's happening in that...that whole
shopping center is undergoing transition, and we'd just be speculating as to what they're
going to do there. We had three of our former Licensees who were in there that have moved
out. There's a lot of vacant land that's in proximity to Ali`i Drive.

Kawakami: My name is Yuka Kawakami. I am the Office and Operations Manager of
the company.

Takase: To help the Commission better understand what's going on here, Sushi Shiono
was the original applicant. They were previously going to move their operation from Alii
Sunset Plaza to this new location at Kona Brewers' Block. They had come in, had done
a change of location, so they've already done all of the notice mailings to the public. In the
interim, they decided to keep both locations; they're going to stay at Alii Sunset Plaza, and
they are still planning to open at the Brewers' Block. I believe it was February?
Kawakami: Yes, we are aiming for February or sometime in March.
Takase: We've been working on the application with them, but we had decided that
there was no need to go back out for publication since they just had done it for the
change of location. It's following the same process, but a little different from maybe what
you have seen, so we're bringing it to you as such. Ownership and everything will
remain the same. They are just going to have two locations now. The only other thing
that they had to do in lieu of mailing notification was to publish notice, which they have
already done with the change of location application.
Masuda: So you're changing the name on the change of location application to Izakaya
Shiono?
Takase: Yes, they're just going to do a dba change to Izakaya Shiono; and Sushi Shiono
will stay at the old location.
Masuda: Maruhiro owns both?
Takase: Yes.

Greenwell: So Gerald, how do we approve this as written?
Takase: Maybe we shouldn't have put it under New Business, but we're okay. Although
it's in two parts, we've approved the location previously. At this point, it should be a dba
name change because that's what all of it boils down to. It's the same ownership that
applied for the change of location; they're just not closing the old location.
Greenwell: Okay, do we give preliminary approval to this and it comes back again next
month? Or do we just approve it understanding amongst ourselves?
Takase: No, it's not necessary because it's the same ownership. Usually, when we do
a preliminary hearing, we're looking at the ownership of that entity; whether they're suitable
for the...but they're already an owner, so it's just for the sake of the name change.
Greenwell: I understand that, but for the sake of paperwork, what we have here in front
of us.
Takase: That's what we determined was the best method to do it.
Masuda: I think part of the issue is, is there going to be two licenses or one license?
Takase: Two separate licenses. In a typical license situation, we go through two
hearings; a preliminary hearing where the Commission will look at the applicant and if
they're okay, then we go to the second step to look at the location. What we're saying
is, we've already looked at the applicant because he's the same applicant. There would
be no basis to turn them down and we're saying that the Commission has already
looked at the location when we did the change of location. Those two steps have
already been taken care of. It's just coming in with a new name and new license at this
one location. We've done it piecemeal, but to the end, we've hit all the marks that were
required.
Masuda: So they're not going to come to the Commission with this application again,
like a brand new applicant, because they already have part of it (completed). Gerald is
saying now, 'you already have the location change, so you're not going to hear from
them again.'
Nahale-a: This is like the second public hearing for this applicant?
Takase: Yes.
Nahale-a: One owner, now two licenses. One at an existing location and one at a new
location that we had already approved to have open with a license. Clear?
Ibarra: The first license is still good?
Takase: Yes.

the typical steps that we would normally see.
Ibarra: So, the application should just be an amendment to the dba, right?
Gonzalez: The agenda description is describing what has already been approved.
They've already had one public hearing for the change of location; that's what Gerald is
saying. Process wise, they've met all the legal requirements.

Takase: Yes, that's the new name, Izakaya Shiono. What we did was flip the process.

Greenwell: Director, they're requesting a temporary increase in the license for November 1,
2019. They just took this over from the previous article above? They just took it over and
they're looking for...is there a special reason why they're already looking for a temporary...
Takase: If you're familiar with the Waikoloa Clubhouse, if I'm looking from the golf course
at it, they have the bar and the restaurant here. They have a banquet room that they used
to the left side of it. O&J has been the owner for a while and they are just changing
members. When they took over the lease, Waikoloa didn't lease that banquet room back
out to the restaurant because they wanted to use it for their events. Each time they have a
big event, they come in for this type of increase. This one was for an after Halloween party
and it didn't come up earlier because we only approved it on the thirty-first. It wasn't in time
to make the November agenda. That's why it got pushed back to December.
Takase: In going through our records, we found that although Ofelia Shively always
thought she was running the place, their paperwork with the DCCA did not match up.
That's why they came in to re-do this part. She was the "0" in O&J LLC. Somehow, when
they did their paperwork, she was left off. It was her and Jennifer Choe that were the
original two that opened it. That's how we got to O&J LLC. She's coming back on, but
she's always been on.

Takase: We asked Hilo Town Tavern to submit a request to the Commission. They are
a Dispenser General which means their hours of operation end at 2:00 A.M. They've
come in making this request for several occasions saying that they have a hard time
getting their patrons out by 2:00; the party's still going and they wanted to stay open.
I told them we don't have such powers, so you are going to have to go to the Commission
about it. I'll tell you by way of background, we haven't had problems with them, but when I

asked the investigators-about them, they said they don't see too many people in there at
2:00 A.M. I don't think it's going to hurt them, but they're trying to avoid having violations
if they do have people in there after 2:00. I'll leave it up to you.
Hughes: Gerald, if they stop serving at 2:00, and there are still people in there, that's
still fine, right?
Takase: Yes, and I think that's their problem. We've talked about it, if they stop serving,
maybe we'll allow you to keep people in there a little longer to get them out. But I told
them it's a question for the Commission to give you that...
Thomas: I have a question about the 3:30 to 4:00. Why don't they just set a fixed
time? What's the 3:30 to 4:00? I don't understand.
Takase: I think they were looking at the Cabaret license which allows closing at 4:00 A.M.
Currently, our only Cabaret (license) is E Komo Mai, and I believe they have a 3:30 closing.
I think that may be why he came up with those hours.
Masuda: I think what she's asking is, Do you want the Commission to set a time, either
3:30 or 4:00?'
Hughes: Or 2:00.
Masuda: Or 3:15 or...
Ibarra: Do you have any other Licensees asking for this kind of amendment to their
license?
Takase: No, we don't. We may...
Ibarra: ...if this passes?
Takase: Yes, and there are certain occasions that may be...like we just had the
Ironman here and Huggo's...that's all they're asking for, special occasions like New
Year's Eve, Cinco de Mayo; Hilo just had a Ho`olaule`a. Those are the things they're
asking for; maybe four or five events during the year. When I asked the investigators
about it, they said they didn't see anybody...
Greenwell: Gerald, this means that they shut down serving at 2:00?
Takase: Yes, currently, the way we enforce the law is when you have a 2:00 closing,
you will close and everybody is out at 2:00. Usually, they have the last call at 1:45 or
1:50.
Greenwell: Yes, but the point I'm getting at is they still are going to shut down at 2:00
as far as the serving goes?
Takase: If you are going to allow them, then yes. That's some of the parameters you can
set. You can say they can serve up until 2:00 and move them (patrons) out. It doesn't

have to be 3:30. I'm sure if you made it 2:30, they'd be happy with that. They're just trying
to avoid being in violation. That's what this owner has expressed to me. Sometimes the
party is still going strong and they're having trouble moving them out that fast.
Greenwell: So it's not an economic beneficial ploy, then; they just can't move them
out?
Takase: Well, they could move them out if they had to. But, they're not going to make
much more; maybe a little more, I'm sure they're going to run their service time closer to
2:00 if they know they can kick them out after 2:00. There might be a small fifteen
minute (period) when you can get one more drink in or two if you're lucky.
Ibarra: Gerald, this is only for December 31st?
Takase: The current one is; but I'm pretty sure, based on what the Commission does...
Ibarra: ...they will come in for more.
Takase: ...they will come in for more, and the word will go around and everybody will
be coming in for more. From the Department's side, we're not endorsing it, but I'm not
going to say we couldn't live with it either. We've punted it to the Commission. Like
I said, from my investigators, they don't see the big push at 2:00 A.M. to get everybody
out. They said everybody's pretty much gone by then anyway. It was just something
the owner brought up, saying he might as well ask. He asked us and I told him we can't
do it, so write a letter to the Commission. It's not like he's going to...
Nahale-a: Mr. Arakaki, you have a question?
Arakaki: I just want a clarification. Is this date, the 31st spilling into the 1st? Or is it
correct?
Takase: New Year's Eve.
Arakaki: New Year's Eve until New Year's morning?
Takase: Yes, technically, his closing would be January 1, 2020.
Ibarra: Is there another license that they can get to address all these...
Takase: They could ask for a Cabaret license and that would give them the ability to
stay open until 4:00 A.M.

and I think we should deny it. If his license goes until 2:00, it's 2:00. Once we open the
doors, we're setting a precedent for other Licensees. This could get out of hand. I think

"The Landing" next door to Honokaa Hotel. They had come in and she had basically
agreed to those conditions which were placed on previously. As I said, those conditions
have lived on for a while and we haven't had problems with the last two or three Licensees
that have been in there.
Onizuka: Can we approve with a condition that they notify the hotel that their hours of
music will be extended just for the New Year's event?
