Ethics Board to be a voice for us. To be a voice that helps compel <br /> State and County officials to uphold their oath to office. Mahalo. <br /> Mr. Robinson: Okay, thank you. I'd like to ask the other people, please levy <br /> yourself to three minutes. We only have so much time to get <br /> through things. Okay the next person is Lanny Sinkin. Mr. Sinkin, <br /> please. Go ahead. <br /> Mr. Sinkin: Earlier I sent in to the Board a memorandum that I prepared about <br /> this whole situation. I hope you've had a chance to read it. If you <br /> have any questions, I'd be happy to address them. But from my <br /> remarks, I want to focus on just two concepts. One is discretion <br /> and the other this morality. I think when you considered <br /> substituting your judgement for the judgment of law enforcement <br /> officials as to whether someone should be arrested or not, that <br /> you're beyond the scope of your authority. And that you're <br /> making a decision on discretion that is normally left to the law <br /> enforcement personnel. When a policeman stops you for speeding, <br /> he has the option of giving you a warning ticket or even letting you <br /> go. And he exercises that discretion in his position. I don't see <br /> that this Board has the discretion to override decisions by law <br /> enforcement agencies as to who should be arrested and win. On <br /> the morality side of things, I think that the previous speaker, well <br /> obviously opposing with what the folks are doing up on the <br /> mountain, highlighted the fact that the...there's a long history here. <br /> That's the context through what you're thinking about doing. And <br /> that history says that there's a...an immoral act that has been <br /> committed starting with the overthrow of the kingdom. And that, <br /> that has been repeated over and over again in different context <br /> where things are done that are wrong and everybody knows they're <br /> wrong. We all know the kingdom is overthrown. That's no secret. <br /> But we act as if it wasn't and that this government has the absolute <br /> right to do whatever it wants on lands that belong to the crown and <br /> the government of the Kingdom of Hawai`i. So I would encourage <br /> you to really,just back off in this situation. I don't think there's a <br /> real role for the ethics commission. There's nothing unethical <br /> about a law enforcement official deciding not to arrest someone. <br /> So I think your appropriate position would be that you've looked at <br /> the issue, we've considered it and it's beyond your jurisdiction. If <br /> you do consider a resolution, I'm assuming this resolution hasn't <br /> been drafted yet. Is that correct? <br /> Mr. Robinson: It has been drafted. <br /> Mr. Sinkin: It has been drafted.
