RAFFIPIY: Let's maintain order in the audience, please. <br />ELLWOOD (from audience): He skipped a part of it. He skipped the under half a mile. <br />TOMLINSON: So, in addition, I'm aware, I read the testimony from the Kamehameha Schools. <br />Kamehameha Schools is approxalmost a quarter of a mile away from this facility, and they <br />were previously notified of the, of the hearing, the previous hearing, and the development of this <br />project, and AT&T would be happy to speak with them further and have a public outreach with <br />them, you know, as a condition of approval for the project. We're always happy to have <br />dialogue and <br />AUDIENCE MEMBER (from audience): —For the parents of the kids [inaudible] <br />HALL: Go ahead [directed to Mr. Tomlinson]. <br />RAFFIPIY: Let's maintain order, please. <br />TOMLINSON: —Yeah, and also I'd like to point out that Kamehameha Schools is an active <br />landlord hosting many, many, many cellular telecommunication facilities throughout the State— <br />ELLWOOD (from audience): [Inaudible] put it on their property <br />RAFFIPIY: I gotta remind the public, please let's maintain order so we can get through this as <br />efficiently as we can. Thank you. <br />TOMLINSON: And, then, lastly, there was some concern about compliance and monitoring <br />regulation of the facility, and I just want to remind the Commissioners its only application that <br />the proposed facility is regulated by the FCC and is in full compliance with the National <br />Environmental Policy Act, and which requires a cultural survey of which we got concurrence of <br />a "no effect" from the State Historic Preservation Division. We did biological surveys, and <br />we've included potential best management practices for dealing with pueo, nesting pueo, bats, <br />and any other natural resources that may be affected. We would be participating in a survey, <br />hiring a survey[or] prior to construction to make sure we would mitigate any effects. Plus, we <br />won't be cutting any trees over 15 feet which are basically following the guidelines of the Fish & <br />Wildlife Service and DLNR. <br />And, I think, lastly and most importantly, I wanted to bring up again that this is a FirstNet site, <br />and to reiterate, what FirstNet is, it's a—sorry I'm going to go back to my notes—FirstNet is a <br />Federal program that AT&T is the contractor for across the country. It was developed out of the <br />9-11 Commission and is designed to create a network for first responders to have complete <br />coverage during times of emergency for their cellular communications. It was vitally they <br />identified it as a vitally important aspect of their work. <br />So, the FirstNet program entails actual firefighters, policemen, getting phones that work on the <br />AT&T network, and they have their own band, in the 700 band, that provides them preemptive <br />EXHIBIT B <br />5 <br />
