I MPROVEMENTS B Y A SSESSMENTS§12-9 <br />Section 12-9. Ratification and validation. <br />The levy of all special assessments, all outstanding improvement bonds of the <br />County payable from special assessments, and all acts and proceedings heretofore had <br />or taken or purportedly had or taken, by or on behalf of the County under law or under <br />color of law preliminary to and in the authorization, execution, sale, issuance, and <br />payment (or any combination thereof) of all such bonds are hereby validated, ratified, <br />approved and confirmed, including but necessarily limited to the terms, provisions, <br />conditions, and covenants of any resolution and ordinance appertaining thereto, the <br />redemption of improvement district bonds before maturity and provisions therefor, and <br />the use of the proceeds of such assessments and bonds, notwithstanding any lack of <br />powers, authority, or otherwise, other than constitutional, and notwithstanding any <br />defects and irregularities, other than constitutional, in such assessments, bonds, acts <br />and proceedings, and in such authorization, execution, sale, issuance and payment, <br />including without limiting the generality of the foregoing, such acts and proceedings <br />heretofore not been levied nor purportedly levied and issued nor purportedly issued. <br />Such outstanding assessments and bonds are and shall be, and such assessments and <br />bonds heretofore not levied nor purportedly levied and issued nor purportedly issued <br />shall be, after such levy or issuance, binding, legal, valid, and enforceable obligations in <br />accordance with their terms and their authorizing proceedings, subject to the taking or <br />adoption of acts and proceedings heretofore not had nor taken, but required by and in <br />substantial and due compliance with laws appertaining thereto. <br />(1983 CC, c 12, art 1, sec 12-9.)12-9 <br />Article 2. Procedure. <br />Section 12-10. Initiation by council; study of proposed improvement; <br />adoption of improvement; hearing. <br />(a) The council shall, by resolution requiring not more than one reading for its <br />adoption, direct the responsible director or manager to prepare and submit to the <br />council a report containing the following: <br />(1) Preliminary data concerning the special improvement proposed to be opened, <br />constructed, or improved; <br />(2) The general character and extent of any improvement to be proposed; <br />(3) The proposed assessment unit and method of assessment; <br />(4) Whether any new land will be necessary to be acquired, and the estimated cost <br />thereof and the proportion of the cost which should be borne by the County; <br />(5) The materials recommended to meet the conditions of the improvement; <br />(6) The boundaries of the proposed improvement district and any subdistricts or <br />zones therein as to which different portions of the cost of improvements should <br />be charged; <br />(7) The estimated cost of the improvement, the portions of the cost to be borne by <br />the County, and the portions of the cost to be assessed against the assessment <br />units specially benefited with the maximum unit of assessment to be made <br />against each assessment unit to be assessed; and <br />12-7 <br /> <br />
