The non-performance is the result of conditions thatcould not. have been foreseen <br /> or are beyond the control of the applicant, successors or assigns, and that are not the <br /> result of their fault or negligence. <br /> 1 Applicant Response: After the first phase of the project was complete the Parish <br /> deemed it necessary to postpone construction on the proposed parish hall in order to <br /> 1 focus efforts on paying off the building debt incurred in the first phase of construction. <br /> i As a result numerous fundraising events were held and pleas for support from <br /> parishioners and the community alike were received and very much appreciated. <br /> However, these efforts still took longer than anticipated to reach the final goal of <br /> f paying off the building debt. Slower than anticipated fundraising results attributed to <br /> prolonging debt reduction efforts. These results could not have been foreseen or <br /> anticipated. <br /> As of now the building debt has been paid in full and it is the intent of the parish to <br /> resume with construction of the new parish hall and finalize this project. <br /> 1 This project was planned to begin construction in early 2020 and be completed before <br /> the SMA Use Permit expiration date (October 14, 2020). COVID-19 has delayed the <br /> permitting process, plan development and general contractor selection which resulted <br /> in delaying the progress of the project as a whole. As such this time extension request <br /> is submitted for your consideration. <br /> I 13. Granting of the time extension would not be contrary to the General Plan <br /> or Zoning Code. <br /> I <br /> Applicant Response: A time extension would not be contrary to the General Plan or <br /> 1 Zoning Code as revisions made to the project substantially reduces the overall size and <br /> i scope of the project. The revised plan eliminates the rectory building, utilizing that <br /> I allotted space for additional parking. It also reduces the parish center from a 2-story <br /> f to a single story parish hall. Additionally, a Final Plan for the current scope was <br /> submitted, reviewed and Approved by the County of Hawaii Planned Department on <br /> October 08, 2019. Their approval implies consistency with the General Plan of the <br /> i Zoning Code. <br /> 4 <br /> C. Granting of the time extension would not be contrary to the original reasons for the <br /> granting of this permit. <br /> Applicant Response: The current SMA Use Permit expires on October 14, 2020. <br /> Applicant has initiated the permitting process and necessary requirements to resume <br /> with construction. A time extension will allow applicant the time necessary to conform <br /> 3 <br /> to the conditions set forth above. <br /> 3 The revisions to this proposed project will reduce and or minimize the overall size and <br /> scope of the project which will not he contrary to the original reason of granting this <br /> permit. <br /> D. The time extension granted shall be for a period not to exceed the period <br /> originally granted for perforrance (i.e., a condition to be performed within <br /> i one year may be extended for up to one additional year). <br /> E. If the applicant should require an additional extension of time, the <br /> Planning Department shall submit the applicant's request to the Planning <br /> Commission for appropriate action. <br /> 4 <br /> 1 <br />
