wanted to make sure that there was some sort of response from SHPD. And the applicant was <br /> ready to proceed, but we had asked them to put the brakes on. We had made a number of <br /> attempts to reach SHPD and request a comment letter. They had made a number of requests. <br /> We had finally received a comment letter, and basically, they said that they had no objections, go <br /> forward. And it was like, okay, and that was that. And that's our, Planning Department Exhibit <br /> 14. <br /> CARR SMITH: Mike. <br /> VITOUSEK: So, that letter from SHPD that reviews the time extension, that is the only thing <br /> that they provided in order to get any documentation that Condition 5 had been adhered to in the <br /> treatment of the lava tube? <br /> DARROW: That's exactly what we asked for. We were saying, look, our condition is very <br /> explicit; it says when you come across these things, you need to stop, you need to contact SHPD <br /> and us, and you need to, you cannot proceed until that's resolved. And we wanted some sort of <br /> response from SHPD that they had done that, and—because we had nothing in our files. <br /> VITOUSEK: Yeah <br /> DARROW: Again, SHPD, the only thing we got from them was our, was that March 14'h letter. <br /> VITOUSEK: Which says that they are not reviewing it because it's a paper transaction, and they <br /> will review it if there is ground disturbance. <br /> DARROW: We had, we - - - something specific to the lava tube. That's what we wanted. <br /> VITOUSEK: Yeah <br /> ANDREWS: Mike, we actually, we actually received that letter, you know, in March of 2019, I <br /> believe it is, from SHPD, and we took the time, you know, as Jeff said, we were concerned, we <br /> actually reached out to SHPD in this series of contacts saying, are you sure this is your final <br /> assessment, we would like a little more elaboration. <br /> VITOUSEK: Yeah <br /> ANDREWS: There was, there was nothing. <br /> VITOUSEK: Wow, that's, that's really too bad. Okay, well - - - for my purposes then, I feel <br /> like we have to treat it as if the applicant is in time. <br /> DARROW: Yeah. <br /> CARR SMITH: Thank you, Mike.
