On that basis, we ask that sufficient <br />notice was provided to the Licensee of this hearing, and that the Board accept this evidence <br />as submitted. <br />Smith: Thank you very much, Ms. Schoen. My script says that I'm supposed to swear <br />in a witness. Does someone need to be sworn in? <br />Schoen: No, Mr. Chair. We're asking that the exhibits provided to the Board be accepted <br />as evidence. <br />Masuda: Mr. Chair, you have to move to accept the evidence. <br />Smith: Thank you. May I have a motion that the Department made diligent efforts to duly <br />notify Licensee of this proceeding, that notice to Licensee was made pursuant to HRS and <br />Liquor Rules, that the Department may proceed with this Alternative III Formal Hearing <br />in the Licensee's absence, and that the Board may adjudicate the complaint and assess <br />penalties as necessary pursuant to Rule 1.8(d). Do I have a motion? <br />Mukai: So move. <br />Taniguchi: Second. <br />Mr. Mukai moved to accept that the Department made diligent <br />efforts to duly notify the Licensee of this proceeding, that notice <br />to the Licensee was made pursuant to HRS and Liquor Rules, <br />that the Department may proceed with this Alternative III Formal <br />Hearing in the Licensee's absence, and that the Board may <br />adjudicate the complaint and assess penalties as necessary <br />pursuant to Rule 1.8(d); seconded by Mr. Taniguchi. <br />Smith: Thank you Dwayne, thank you Art.
