16-3. Definitions. As used in this Article, unless the context specifically indicates <br />otherwise: <br />"Commission" means the Environmental Management Commission of the county. <br />"Common interest development" means a development characterized by individual <br />ownership of a condominium housing unit or a residential parcel coupled with the shared <br />ownership of (or right to use) common areas and facilities, including, but not limited to, <br />condominium projects, community apartment projects, stock cooperatives and planned unit <br />developments, which contains three (3) or more dwelling units and which has a sewer service <br />lateral shared by three (3) or more dwelling units. <br />"Customer" means sewer account holder, the owner of the property, and water account <br />holder for any water service associated with the sewer account. <br />"County" means the County of Hawai'i. <br />"Defective condition" includes, but is not limited to, a condition that will allow I & I or <br />exfiltration of sewage including non -sanitary sewer connections to the private sewer or to any <br />wastewater plumbing that connects to the public sewer lateral, and other violation of County <br />Standards and requirements. <br />"Delinquent" means an indebtedness to the Department unpaid for more than thirty <br />(30) calendar days from the date of the bill. <br />"Day" means calendar day unless otherwise specified. <br />"DCCA" means the Department of Commerce and Consumer Affairs. <br />"Department" means the Department of Environmental Management. <br />"Director" means the Director of the Department of Environmental Management or the <br />director's authorized representative. <br />"Discontinuation of water service" or "termination of water service" means shutting off <br />water service. <br />"DWS" means the Department of Water Supply. <br />"HCC" means the Hawai'i County Code. <br />"HRS" means Hawai'i Revised Statutes. <br />33 <br />
