Merit Appeals Board <br />December 16, 2020 <br />CHR. NAMAHOE: Representative Shook, so that you understand. I want to make sure that <br />we're being clear here and I appreciate this questioning this line of questioning. If you take <br />this into a protected class area, it moves right out of our jurisdiction. <br />REP. SHOOK: Okay. So, Mr. Shook, were you disappointed upon being told or given this <br />information that you would not be allowed to proceed? <br />APPELLANT SHOOK: Yes. Immediately after the situation, I went straight to the Hilo HR, <br />which is in the building across the street from us, to request clarification on statements by <br />Mr. Reyes. <br />REP. SHOOK: Mr. Reyes told you that you would not get into the department because if you <br />failed the first time, you failed for life. Do you feel that this is a proper response? <br />APPELLANT SHOOK: No. <br />REP. SHOOK: Did Mr. Reyes emphasize or explain in any way why he came to this <br />conclusion? <br />APPELLANT SHOOK: He simply said based on what I see here, you're not getting in. He <br />also the only clarification he gave was—and I quote, "I don't know how they do it in other <br />counties but, here, if you don't get in, you don't get in." <br />REP. SHOOK: Was there any other statements that Officer Reyes might have said, like—does <br />somebody else have to look at it to agree or somebody takes whatever he says, or he's looking at <br />something and saying this is enough to keep you out, period. <br />Do you feel that he had anything there that could keep you out? <br />APPELLANT SHOOK: No. <br />REP. SHOOK: Did he allow you to see what he referred to? <br />APPELLANT SHOOK: No. <br />REP. SHOOK: When Officer Reyes sent you out the door, you said you signed one piece of <br />paper? <br />APPELLANT SHOOK: Yes, there was a form for us both to sign to mark that he reviewed it <br />with me—he sign, I sign. <br />REP. SHOOK: Did Officer Reyes go through the PHQ process with you at any time? <br />APPELLANT SHOOK: I believe me going to his office, that's what going through the PHQ <br />was. <br />Page 14 <br />
