ROY: I believe the Applicant probably can speak to that, but I believe it is ongoing right now. I <br /> know a number of the testing of course took some time locating the concentrations within the <br /> soil and so in that sense the project is ongoing but the Applicant maybe able to speak exactly to <br /> as to what is happening right now currently with lead remediation, soil remediation. <br /> CLARKSON: Well, my question really is probably for the DOT but, if we didn't approve an <br /> SMA and I can't remember us doing it for that project why are they, how are they able to have a <br /> project like that in the SMA area without a permit? <br /> ROY: Well, I'm not sure if that's, yeah, I'm not sure. I mean the DOT right-of-way you are <br /> dealing with two (2) different things you have the Conservation District which the State has <br /> authority regulatory authority over uses. In this case, the SMA is dealing with the impacts and in <br /> the SMA but you don't approve uses. Also, in the DOT right-of-way I believe that they have the <br /> authority to conduct activities that are necessary to protect and to preserve the right-of-way but <br /> again they can probably speak to exactly what's going on right now outside of the project parcel. <br /> I'm not sure. <br /> CLARKSON: Okay. <br /> ROY: I'm not sure within the project parcel, you are approving soil remediation within the <br /> project parcel. <br /> CLARKSON: Which I saw on the map does not extend to the right-of-way perhaps, State the <br /> highway projects are exempt from SMA permits I'm not familiar with "—" <br /> ROY: Yeah, I'm not sure "—" From my past experience with DLNR, yeah DOT kind of has <br /> authority within the right-of-way to deal with what's necessary within the right-of-way to keep <br /> that functional. But again, yes you are approving soil remediation in this project parcel which is <br /> the park parcel. I have one, it was in your list of <br /> things that they were going to do, and it was referring to the Kolekole Stream regarding shower <br /> runoff. What is meant by that? Rain showers or human showers or — <br /> ROY: Human showers.
