A DMINISTRATION § 2-15 <br />Section 2-15. Fire commission. * <br />There shall be a fire commission, which shall consist of nine members. One member <br />shall be a resident of each council district. The commission may appoint such staff and <br />engage such consultants as necessary for the performance of its duties. The members <br />shall be appointed by the mayor and confirmed by the council in the manner prescribed <br />in section 13-4, Hawai‘i County Charter 2000. <br />(2001, ord 01-109, sec 2.)2-15 <br />* Editor’s Note: Section 2-15, formerly entitled “Duties,” was renumbered section 2-14 and renamed “Powers, Duties <br />and Functions” by Ordinance 01-109. Section number 2-15 was assigned to a new section named, “Fire commission”. <br />Section 2-15.1. Powers, duties and functions. <br />The fire commission shall: <br />(1) Adopt rules necessary for the conduct of its business and review rules for the <br />administration of the department; <br />(2) Review the annual budget prepared by the fire chief and make <br />recommendations thereon to the mayor, the managing director and the <br />council; <br />(3) Review the department’s operations as deemed necessary, for the purposes of <br />recommending improvements to the fire chief; <br />(4) Evaluate at least annually the performance of the fire chief and submit a <br />report to the mayor, the managing director and the council; <br />(5) Review personnel actions within the department for conformance with the <br />policies under section 7-4.2, Hawai‘i County Charter; <br />(6) Hear complaints of citizens concerning the department or its personnel and, if <br />necessary, make recommendations to the fire chief on appropriate corrective <br />actions; and <br />(7) Submit an annual report to the mayor, managing director and the council on <br />its activities. <br />Except for purposes of inquiry or as otherwise provided in the Hawai‘i County <br />Charter, neither the commission nor its members shall interfere in any way with the <br />administrative affairs of the department. <br />(2001, ord 01-109, sec 2; am 2011, ord 11-103, sec 3.)2-15.1 <br />Article 6. Volunteer Fire Department. <br />Section 2-16. Volunteer fire department created. <br />There is created and established for and within the County a department to be <br />known as the Hawai‘i volunteer fire department to train volunteers in the prevention of <br />fires and to aid in the control of fires.
