§ 5-1-3 H AWAI‘I C OUNTY C ODE <br />(B) In an approved subdivision, where the work is in planned or actual <br />roadways or other common infrastructure areas; <br />(3) Pursuant to section 448E-13, Hawai‘i Revised Statutes, work by employees of <br />a public utility within the State under a franchise or charter granted by the <br />State which is regulated by the public utilities commission and community <br />antennae television company, while so employed; <br />(4) Electrical work related to work regulated by chapter 397, Hawai‘i Revised <br />Statutes, relating to the elevator code, but not including electrical work for the <br />supply of power to the control panels of elevators, dumbwaiters, escalators, <br />moving walks, and manlifts; <br />(5) Replacement or repair of electrical devices and apparatus for air conditioning, <br />refrigeration, and heating systems, except electrical work on overcurrent <br />devices that are not physically attached to, or physically mounted on, such <br />systems; <br />(6) The construction, alteration or repair of electrical devices commonly used in <br />the home such as portable appliances as defined in section 5-1-5; <br />(7) Plumbing work related to work regulated by chapter 397, Hawai‘i Revised <br />Statutes, relating to boilers and pressure vessels; and <br />(8) Agricultural buildings, structures, and appurtenances without electrical power <br />and plumbing systems are exempt from permit and construction code <br />requirements pursuant to section 46-88, Hawai‘i Revised Statutes, except as <br />otherwise provided for in this construction code. No electrical power and no <br />plumbing systems shall be connected to a building or structure without first <br />obtaining a permit for electrical or plumbing work. <br />(2020, ord 20-61, sec 2; am 2021, ord 21-61, sec 4.) 5-1-3 <br />Section 5-1-4. Existing buildings. <br />(a) Permitted buildings in existence at the time of the adoption of this code may have <br />their existing permitted use or occupancy continued if such use or occupancy was <br />legal at the time of the adoption of this code, provided such continued use does not <br />constitute a hazard to the general safety and welfare of the occupants and the <br />public. <br />(b) Alteration, repair, addition, and change of occupancy. Alteration, repair, addition, <br />and change of occupancy to a building or structure in existence at the time of the <br />adoption of this code shall comply with the requirements of chapter 34 of the <br />International Building Code, relating to existing structures, until the adoption by <br />the County of the International Existing Building Code. * <br />(2020, ord 20-61, sec 2.) 5-1-4 <br />* Editor’s Note: The County adopted the International Existing Building Code on September 8, 2021, in Ordinance 21-41. <br />Section 5-1-5. Definitions. <br />As used in this chapter, unless it is apparent from the context that a different <br />meaning is intended: <br />2 <br />“Accessory structure” means a structure not greater than 3,000 square feet (279 m) <br />in floor area, and not over two stories in height, the use of which is customarily <br />accessory to and incidental to that of the dwelling and which is located on the same lot. <br />SUPP. 11 (1-2022) <br />5-2 <br /> <br />
