P ARKS AND R ECREATION § 15-1 <br />CHAPTER 15 <br />PARKS AND RECREATION <br />Article 1. General Provisions. <br />Section 15-1. Purpose of chapter. <br />The purposes of this chapter are: <br />(1) Preservation of the beauty of Hawai‘i, its way of life and its Aloha spirit; <br />(2) Moral, physical and economic well-being of the citizens and residents of the <br />County; <br />(3) Utilization of land resources in the County in an intelligent and reasonable <br />manner based on the capabilities and characteristics of the soil, its physical <br />surroundings, climate, and the needs of the people in the County together with <br />any other relevant and material considerations; <br />(4) Establishment of recreational and cultural facilities that will provide <br />healthful, educational, and aesthetic advantages for the people in the County <br />and its visitors, and for the orderly and progressive development of such <br />facilities to accommodate the expanding and diversified needs of the people; <br />and <br />(5) Protection and enhancement of the scenic and historic resources of the area. <br />(1983 CC, c 15, art 1, sec 15-1.)15-1 <br />Section 15-2. Applicability and scope of chapter. <br />(a) This chapter shall apply to all County park areas. <br />(b) The provisions in this chapter, including provisions for the imposition upon any <br />person of the penalties by fine or imprisonment for any violation of this chapter, are <br />not to be construed to exclude the operation of applicable State statutes or other <br />County ordinances. In the case of conflict with other County ordinances, the stricter <br />ordinance may apply. <br />(c) The director, or the director’s authorized representative, shall implement and <br />administer the provisions of this chapter. <br />(d) The director or the director’s authorized representative, may authorize a temporary <br />or limited term exception from any provision of this chapter when determined to be <br />in the best interest of the department, the County, or the public. <br />(1983 CC, c 15, art 1, sec 15-2; am 2001, ord 01-3, sec 1; am 2023, ord 23-11, sec 1.)15-2 <br />Section 15-3.
