It is her duty to inform us of the agenda and that we are on track with <br /> Sunshine Laws and to be, you know, she's doing her job and please be respectful, and if you'd <br /> like to direct something to her,please request from me to have the floor in order to ask a question <br /> of her. We have to follow rules of order in this meeting, and everything has got to go as the way <br /> it should, okay? Are there any other questions <br /> VAN PERNIS: (Indiscernible—simultaneous speech) <br /> VITOUSEK: Hold on. Are there any other questions specifically about this agenda item for <br /> couns- for staff? Okay, last one, Commissioner Van Pernis, and then we'll move forward with <br /> the applicants. <br /> VAN PERNIS: My question now is as before, concerns this application. What circumstance <br /> beyond the control of the applicant justifies this request for an extension? And, is their financial <br /> condition, is the Planning Department taking their financial condition as a reason for <br /> circumstance beyond their control? <br /> KERN: Are you referring to this <br /> VITOUSEK: (Indiscernible—simultaneous speech) Director Kern, we are addressing the <br /> application from the Young `ohana who purchased the property after the ordinance had expired. <br /> So, clearly, this is through no fault of their own that the ordinance was expired, because they <br /> have purchased the property after the fact that it expired. They are the parry who we are <br /> considering. So, with that, we will move forward with the applicant's presentation. We have <br /> Ernest and Elizabeth Young. Are you guys available? (No audible response) Okay, hey, how's <br /> it? <br /> MR. YOUNG: Yep, how's it? <br /> VITOUSEK: Right on. Please raise your right hand. Do you swear or affirm to tell the truth on <br /> this matter now before the Leeward Planning Commission? <br /> MR. YOUNG: Yes. <br /> MRS. YOUNG: Yes, I do. <br /> VITOUSEK: Okay, thank you.
