Z ONING § 25-2-62 <br />Section 25-2-62. Application for use permit; requirements. <br />(a) An application for a use permit shall be made to the commission, in accordance <br />with its rules, on a form prescribed by the commission. <br />(b) The application shall be accompanied by: <br />(1) A filing fee of $500; <br />(2) A description of the property in sufficient detail to determine the precise <br />location of the property involved; <br />(3) A plot plan of the property, drawn to scale, with all existing and proposed <br />structures shown thereon; <br />(4) A list of names, addresses and tax map key numbers for those owners and <br />lessees of record of surrounding properties who are required to receive notice <br />under section 25-2-4; and <br />(5) A written description of the proposed use and a statement of objectives and <br />reasons for the request, including an analysis of how the request satisfies each <br />of the standards contained in section 25-2-65. <br />25-2-62 <br />(1996, ord 96-160, sec 2; ratified April 6, 1999; am 2011, ord 11-3, sec 2.) <br />Section 25-2-63. Procedure for use permit. <br />(a) Upon acceptance of a use permit application, the commission shall fix a date for a <br />public hearing. The public hearing shall be commenced no later than ninety days <br />after the acceptance of a use permit application by the director. <br />(b) The applicant shall serve notice of the use permit application on surrounding <br />owners and lessees of record as provided by section 25-2-4. The applicant shall also <br />serve notice on owners and lessees of record interests in other properties which the <br />commission may find to be directly affected by the use permit sought. The <br />applicant shall also post a sign for public notification on the property as provided by <br />section 25-2-12. <br />(c) Prior to the public hearing, the commission shall publish notice of the public <br />hearing in accordance with the requirements of this chapter. <br />(1996, ord 96-160, sec 2; ratified April 6, 1999; am 1999, ord 99-112, sec 9; am 2005, <br />ord 05-136, sec 5; am 2010, ord 10-117, sec 2.)25-2-63 <br />Section 25-2-64. Action on use permit. <br />(a) Within sixty days following the close of the public hearing or public hearings as the <br />case may be, or within such longer period as agreed to by the applicant, the <br />commission shall either deny or approve the application. The commission’s decision <br />shall be accompanied by a statement of factual findings supporting the decision. <br />(b) In approving any use permit application, the commission may issue the approval <br />subject to conditions, including but not limited to hours of daily operation and <br />terms of the use permit.
