WILLE: Yes, by the County I mean and developers now asking to eliminate road improvements <br /> on Kapi`olani Road which is what the street that runs by where the gymnasiums going in and is <br /> asking to waive those requirements. They have left in place that when the Middle School is built <br /> that this requirement will come up again and it may well at that time be requested to be waived <br /> again. But this was those safety concerns were the major probably the number one concern for <br /> the community. There is also at that time, in fact my brother lives there and there were problems <br /> and the school is going to increase and increase in number of students over the years. So, here <br /> we have a requirement and then we go and just want to let it go. <br /> VAN PERNIS: Excuse me Ms. Campbell. <br /> WILLE: Wille. <br /> VAN PERNIS: I want to find out if the settlement agreement provides for safety precautions or <br /> whatever that the County recommendation and the Parker School are all trying to circumvent? <br /> WILLE: Right. That's right. <br /> VAN PERNIS: So, the County is being asked to allow the school to violate the settlement <br /> agreement? <br /> WILLE: Yes. <br /> VAN PERNIS: On the base the litigation was dismissed from the basis of the settlement <br /> agreement? <br /> WILLE: That's right. <br /> VAN PERNIS: Alright, thank you. <br /> VITOUSEK: Question for Ms. Wille. Is there a timeline established or deadline established for <br /> when the road improvements have to be put in place? <br /> WILLE: It was concurrent with the gymnasium and/or the Middle School. <br /> VITOUSEK: So, the settlement reflects the existing language in the Use Permit? <br /> WILLE: Yes. <br /> VITOUSEK: Commissioner DeFranco do you have a question as well? <br /> DEFRANCO: Yes, it was along those lines too Mike. In reading this I understood that because <br /> the school was not up in enrollment and they were not building the Middle School as of yet. <br /> Then, that the road requirement wasn't being they are asking to put it off until the Middle School <br /> is developed, is that, am I understanding that right Ms. Wille? <br /> 3 <br /> EXHIBIT A <br />
