KAY: Uh <br /> VAN PERNIS: were made by the planning director during that time, right? <br /> KAY: Yes, so the background report identifies when there were administrative time extensions <br /> granted, and that was done by the planning director at the time. <br /> VAN PERNIS: And during, from 1989 until now,there's been substantial changes in the <br /> amount of traffic on Alii Drive and Kamehameha III Road, the Life Care Center has been built, <br /> the shopping center there has been built, and there have been innumerable other projects and <br /> houses built during that period of time, right? <br /> KAY: I'm aware of the Care Center and the 44-unit phase one. I don't know exactly the history <br /> of all the other development in the area. But, yes, there has been construction since the time 286 <br /> was granted. <br /> VAN PERNIS: And what additional infrastructure requirements have been added since 1989 to <br /> this project? Public infrastructure. <br /> KAY: There are requirements for curb-gutter-and-sidewalk improvements along the frontages of <br /> parcel 90 and parcel 78 prior to <br /> VAN PERNIS: That was—when, when was that first imposed? <br /> KAY: I'd have to look back; I don't know exactly at what point in the process that was required. <br /> I know it's carried through from the 2015 amendment. Sid may be able to address that, or the <br /> applicant may be able to address when those requirements were added. <br /> VAN PERNIS: Some time before 2015, is that correct? <br /> KAY: I'm not exactly sure. If it was done prior to 2015, but I know in 2015 that was one of the <br /> conditions that was part of the permit. <br /> VAN PERNIS: Now, has the public had an opportunity to weigh in on what additional <br /> infrastructure since 1989 and 2015 is appropriate? <br /> KAY: The public has had an opportunity, as the amendments have come in front of the Planning <br /> Commission, to participate in those hearings. I think that the zoning in this area has always been <br /> RM-3, so the entitlement that has been, was requested in 1989 and has been amended <br /> throughout, has been the SMA permit. And I believe we talked about this before as a <br /> commission that the traffic is not one of those discussions, or those type of roadway <br /> infrastructure pieces are not one of those triggers like a zoning would be, if this was like a zoning <br /> change. <br /> 10 <br /> EXHIBIT D <br />
