Zendo Kern <br /> July 26, 2021 <br /> Page 2 <br /> emergency assistance vehicles, which are stored on-site and which provides short- <br /> term parking for repossessed vehicles and damaged vehicles that are awaiting <br /> transport to Oahu or to maintenance and repair facilities on the island (collectively <br /> the "Facility"). <br /> The Facility consists of a 3,591 square feet shop building and a 672 square feet office <br /> trailer, gravel parking and is partially hog wire fenced(Exhibit 1-site plan). <br /> B. The Applicant is requesting an amendment to Conditions 3, 6 and 7 under SPP 1247 as <br /> follows (collectively, the "amendment request"). Deleted text is [stfieke ] and new text <br /> is underscored. <br /> 1. Request No. I -Amend Condition 3 (life of the permit) to run with the current <br /> owner. <br /> "2. The life of the permit shall run with the current owner, <br /> [David AkC-ollemgh Tfft;s,4J David McCollough and John <br /> Roth, partners under the Hawaii Civil Union Act and Mark <br /> and Dianna Farias, a married couple and shall cease upon <br /> sale or transfer of the property or sale or transfer of the <br /> business to a different owner. <br /> Reason: David McCollough, Trustee under that certain unrecorded Trust <br /> Agreement dated January 22, 2002, conveyed all of his right, title and interest in <br /> and to the Property to David McCollough and John Roth, partners under the <br /> Hawaii Civil Union Act and Mark Farias and Dianna Farias , a married couple, as <br /> tenants in common, by Trustee's Limited Warranty Deed, dated February 7, 2020, <br /> and recorded in the Bureau of Conveyances of the State of Hawaii in Document <br /> No. A-73450693 (Exhibit 2). David McCollough continues to be a current owner <br /> of the Property and is the sole managing member of RT's Service, LLC, the <br /> operator of the Facility. <br /> 2. Request No. 2 -Amend Condition 6 (secure building, electrical and plumbing <br /> permits). <br /> "6. Building,plumbing and electrical permits shall be <br /> secured andfinalized to convert the barn into a vehicle <br /> repair shop within [&He-yea-F] two years from the effective <br /> date of this amended permit. The vehicle repair shop shall <br /> only be used for peeforming motor vehicle and motorcycle <br /> inspections, and repair qt'tow trucks, emergency service <br /> vehicles and the applicant's personal vehicles. The vehicle <br /> repair shop shall not be used for repairing clients <br /> vehicles." <br /> Dianna Farias is David McCullough's sister. <br />
