That Grantor, for and in consideration of the sum of
<br /> ONE DOLLAR ($1.00), does hereby grant, bargain, sell and convey
<br /> unto Grantees, its successors and.assigns, as follows:
<br /> - an undivided FIFTY PERCENT INTEREST (SOS) to
<br /> DAVID MCCOLLOUGH and JOHN ROTH, partners under the Hawaii Civil
<br /> Union Act, as TENANTS BY THE ENTIRETY, Tenants in Common, with
<br /> - an undivided FIFTY PERCENT INTEREST (50%) to MARK
<br /> FARIAS and DIANNA FARIAS, husband and wife, as TENANTS BY THE
<br /> ENTIRETY,
<br /> forever, the property situated on the Island of
<br /> Hawaii, State of Hawaii, and described in Exhibit A attached
<br /> hereto and by this reference made a part hereof.
<br /> TO HAVE AND TO HOLD the same, together with all
<br /> buildings and improvements thereon, all rights, privileges, and
<br /> easements held or enjoyed in connection therewith, all rents,
<br /> issues and profits therefrom, or appurtenant thereto, and all of
<br /> the estate, right, title and interest of Grantor therein and
<br /> thereto, unto Grantee, Grantee's successors and assigns,
<br /> forever.
<br /> AND Grantor, for itself as said trustee and not
<br /> individually, and its successors in trust, does hereby covenant
<br /> and agree with Grantee, Grantee's heirs, legal representatives
<br /> and assigns, that Grantor has good right to sell and convey the
<br /> premises hereinbefore conveyed; that said premises are free from
<br /> all encumbrances made of suffered by it; and that it will
<br /> WARRANT AND DEFEND the same unto the Grantee, Grantee's heirs,
<br /> legal representatives and assigns, forever, against any and all
<br /> encumbrances made of suffered by Grantor.
<br /> AND Grantor remises, releases, and forever quitclaims
<br /> unto Grantee, Grantee's heirs, legal representatives and assigns
<br /> all of their right, title, and interest in and to any alleys,
<br /> streets, ways, easements, strips, or gores abutting or adjoining
<br /> the granted premises.
<br /> AT ALL TIMES HEREIN the terms "Grantor" and "Grantee"
<br /> or any pronouns used in place thereof, shall mean and include
<br /> the masculine or feminine, singular or plural number, and
<br /> individuals, firms or corporations, and their and each of their
<br /> respective heirs, legal representatives, successors and assigns,
