R ESIDENTIAL B UILDING C ODE §5B-1-1 <br />CHAPTER 5B <br />RESIDENTIAL BUILDING CODE* <br />* Editor’s Note: Pursuant to section 107-28, Hawai‘i Revised Statutes (“HRS”), each County shall amend and adopt the Hawai‘i State <br />building codes and standards listed in HRS, section 107-25 within two years after adoption by the State Building Code council. If a <br />County does not amend, adopt, and update a State code within this time frame, the respective State code shall become applicable as an <br />interim County code. <br />Article 1. General Provisions. <br />Section 5B-1-1. Title. <br />This chapter shall be known as the “residential building code.” <br />(2021, ord 21-61, sec 1.) 5B-1-1 <br />Section 5B-1-2. Purpose. <br />The purpose of this chapter is to provide minimum standards to safeguard life or <br />limb, health, property and public welfare by regulating and controlling the design, <br />construction, quality of materials, use and occupancy, location and maintenance of all <br />residential buildings and structures within the County and certain equipment <br />specifically regulated herein. <br />(2021, ord 21-61, sec 1.) 5B-1-2 <br />Section 5B-1-3. Scope; exceptions. <br />This chapter shall apply to the design, construction, alteration, movement, <br />enlargement, replacement, repair, equipment, use and occupancy, location, removal and <br />demolition of detached one- and two-family dwellings and townhouses not more than <br />three stories above grade plane in height with a separate means of egress and their <br />accessory structures not more than three stories above grade plane in height. <br />Exception: <br /> The following shall be permitted to be constructed in accordance with this code <br />where provided with a residential fire sprinkler system complying with, chapter 26, the <br />Hawai‘i County fire code: <br />1. Live/work units located in townhouses and complying with the requirements of <br />Section 419, “Live/Work Units” of the International Building Code as adopted <br />by chapter 5A, the building code. <br />2. Owner-occupied lodging houses with five or fewer guestrooms. <br />3. A care facility with five or fewer persons receiving custodial care within a <br />dwelling unit. <br />4. A care facility with five or fewer persons receiving medical care within a <br />dwelling unit. <br />5.
