Petition 2021-14: Petition alleging that the Director of Parks and Recreation is <br />derelict in his duties, failing to provide leadership with integrity and obstructing <br />justice. <br />c. Petition 2021-15: Petition alleging that the Chair and Vice Chair of the Leeward <br />Planning Commission violated Hawaii County Charter 6-7-5, quorum <br />requirements, and Ethics Code 2.81, 2.82, 2.83(a)(3), and 2.86(b). <br />d. Petition 2021-16: Petition from a County Program associated with the recovery <br />from the 2018 Kilauea eruption, requesting Informal Advisory Opinion that the <br />policies and procedures adopted by the Program are sufficient to satisfy the <br />Hawaii County Code of Ethics as applied to County employees applying to the <br />Program or that an opinion from the Board is not required pursuant to Hawaii <br />County Code Section 2-83(c). <br />e. Petition 2021-17: Petition from a County Program associated with the recovery <br />from the 2018 Kilauea eruption, requesting Informal Advisory Opinion that the <br />policies and procedures adopted by the Program are sufficient to satisfy the <br />Hawaii County Code of Ethics as applied to the Planning Director and Program <br />Manager as applicants to the Program or that an opinion from the Board is not <br />required pursuant to Hawaii County Code Section 2-83(c). <br />5. UNFINISHED BUSINESS <br />a. Petition No. 2021-05: Review draft Order dismissing petition requesting guidance <br />as to whether the actions of a Leeward Planning Commissioner are in violation of <br />the Code of Ethics. <br />6. EXECUTIVE SESSION <br />With reference to agenda items listed, one or more executive meetings are anticipated. In <br />particular, the Board of Ethics anticipates it may consider the evaluation, dismissal, or <br />disciplining of an officer or employee of the County of Hawai'i, where considerations of <br />matters affecting privacy will be involved. The Board may also consult with the Board's <br />attorney on questions and issues pertaining to the Board's powers, duties, privileges, <br />immunities, and liabilities. Therefore, pursuant to Hawai'i Revised Statutes ("HRS") <br />Sections 92-5(a)(2), 92-5(a)(4), and 92-6(a)(2), the following items may be considered in <br />Executive Session. <br />a. Review of the executive session minutes of October 13, 2021. <br />7. CONTINUED DISCUSSION REGARDING AMENDMENTS TO THE RULES OF <br />PRACTICE AND PROCEDURE OF THE BOARD OF ETHICS AND THE HAWAII <br />COUNTY CHARTER AND COUNTY CODE. <br />
