During construction,measures shall be taken to minimize the potential of both fugitive <br /> dust and runoff sedimentation. Such measures shall be in compliance with construction <br /> industry standards and practices utilized during construction projects of the State of <br /> Hawaii. <br /> 24. A National Pollutant Discharge Elimination System (NPDES) permit and an <br /> Underground Injection Control (UIC)permit, if required, shall be secured from the State <br /> Department of Health before the commencement of construction activities. <br /> 25. The Applicant shall comply with all other applicable laws, rules,regulations, and <br /> requirements, including those of the Department of Water Supply, the Department of <br /> Public Works,the Department of Land and Natural Resources. <br /> 26. An annual progress report timed in conjunction with the combined annual progress <br /> reporting currently submitted by Waikoloa Land Company, shall be submitted to the <br /> Planning Director prior to the anniversary date of the effective date of this permit. The <br /> report shall include, but not be limited to, the status of the development and to what <br /> extent the conditions of approval are being complied with. This condition shall remain in <br /> effect until all of the conditions of approval have been complied with and the Planning <br /> Director acknowledges that further reports are not required. <br /> 27. Should any of the foregoing conditions not be met or substantially complied with, the <br /> Planning Director may initiate procedures to revoke the permit. <br /> -18- <br />
